Heard      learned           counsels          for     the<\/p>\n<p>                   petitioners and the State.\n<\/p>\n<p>                           The petitioners are apprehending their<\/p>\n<p>                   arrest in a case registered under Sections<\/p>\n<p>                   341,323, 325,436\/34 of the I.P.C.<\/p>\n<p>                           It is submitted by the learned counsel<\/p>\n<p>                   for   the   petitioners         that       only    accusation<\/p>\n<p>                   under   Section        436    of     the   I.P.C.        is    not<\/p>\n<p>                   bailable.\n<\/p>\n<p>                           Since     the        specific       allegation          of<\/p>\n<p>                   litting     the       house     on     fire       is     against<\/p>\n<p>                   petitioner no. 2, Niyamat, I am not inclined<\/p>\n<p>                   to grant anticipatory bail to petitioner No.<\/p>\n<p>                   2,    Niyamat.        The     prayer       for     grant        of<\/p>\n<p>                   anticipatory          bail     of      petitioner             no.2,<\/p>\n<p>                   Niyamat is rejected.\n<\/p>\n<p>                           However,       learned        court       below        may<\/p>\n<p>                   consider    the       regular      bail    application          of<\/p>\n<p>                   petitioner      No.    2,     Niyamat      considering          the<\/p>\n<p>                   fact that there is case and counter case if<\/p>\n<p>                   the petitioner No. 2, Niyamat surrenders and<\/p>\n<p>                   prays for regular bail within a period of<\/p>\n<p>                   four weeks from today.\n<\/p>\n<p><span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>                Learned    counsel        for    the    petitioners<\/p>\n<p>       further submitted that during investigation<\/p>\n<p>       it has come that the house was not burnt.<\/p>\n<p>                Let the other petitioners, Jahangir,<\/p>\n<p>       Md.   Kamruddin        @    Karmuddin,      Md.    Jabbar    @<\/p>\n<p>       Jabbar, Siddique, Lelai Miyan, Amna Khatoon,<\/p>\n<p>       Samira    Khatoon       @    Samida,     Salemani      Khatoon<\/p>\n<p>       and Chunni Khatoon be released on bail in<\/p>\n<p>       the event of arrest or surrender before the<\/p>\n<p>       learned    court       below      within     a    period     of<\/p>\n<p>       twelve weeks from today in connection with<\/p>\n<p>       Jogbani (Bathanaha) P.S. Case No. 53 of 2010<\/p>\n<p>       on furnishing bail bond of Rs. 10,000\/-(Ten<\/p>\n<p>       Thousand) each with two sureties of the like<\/p>\n<p>       amount    each     to       the   satisfaction         of   the<\/p>\n<p>       learned     C.J.M.
