Justice R.BASANT\n\n Dated :10\/03\/2008\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                       B.A.No.1089 of 2008\n                   ----------------------------------------\n           Dated this the 10th day of March 2008\n\n                              O R D E R\n<\/pre>\n<p>      Application   for    anticipatory          bail.      The petitioner<\/p>\n<p>apprehends arrest on the allegation that he has committed<\/p>\n<p>offences punishable under the Customs Act. Interim directions<\/p>\n<p>were issued and the petitioner had made himself available for<\/p>\n<p>interrogation before the investigating officer.               The learned<\/p>\n<p>counsel for the respondent submits that investigation has not<\/p>\n<p>been completed and the petitioner is required to be arrested<\/p>\n<p>now.\n<\/p>\n<p>      2.   According to the learned counsel for the respondent,<\/p>\n<p>the petitioner, who was allegedly employed abroad in a rent a<\/p>\n<p>car firm, has imported a very costly car into India.                  The<\/p>\n<p>petitioner has not explained his source for importing the car nor<\/p>\n<p>has he explained the source from which he was able to pay the<\/p>\n<p>duty payable in respect of the vehicle. The respondent suspects<\/p>\n<p>tampering with the engine number and the chasis number of the<\/p>\n<p>car. It is suspected that the petitioner is also one of the persons<\/p>\n<p>who are made use of by some others for illicit import into India<\/p>\n<p>of cars in the name of persons like the petitioners.                More<\/p>\n<p>detailed investigation is necessary. At this stage, the petitioner<\/p>\n<p><span class=\"hidden_text\">B.A.No.1089\/08                  2<\/span><\/p>\n<p>may not be permitted to arm himself with an order              of<\/p>\n<p>anticipatory bail. He may be permitted to surrender before the<\/p>\n<p>investigating officer     or the learned Magistrate having<\/p>\n<p>jurisdiction and then seek regular bail in the ordinary course.<\/p>\n<p>      3.    The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is innocent. If at all there be any impropriety<\/p>\n<p>regarding the import of the car, proceedings can be initiated<\/p>\n<p>under the Customs Act and penalty, if any, may be imposed.<\/p>\n<p>There is absolutely no necessity to insist on the arrest and<\/p>\n<p>incarceration of the petitioner.   In these circumstances, the<\/p>\n<p>petitioner may be granted anticipatory bail, it is submitted. The<\/p>\n<p>learned counsel for the petitioner submits that the petitioner is<\/p>\n<p>willing to co-operate with the investigating officers. His arrest<\/p>\n<p>and detention is not necessary. Appropriate directions may be<\/p>\n<p>issued under Section 438 Cr.P.C, it is submitted.<\/p>\n<p>      4.    I have heard the learned counsel for the rival<\/p>\n<p>contestants.     I find merit in the opposition by the learned<\/p>\n<p>counsel for the respondent. The respondent is entitled for an<\/p>\n<p>adequate opportunity to conduct a complete an exhaustive<\/p>\n<p>investigation about the circumstances under which chasis and<\/p>\n<p>engine numbers are suspected to be tampered. Respondent is<\/p>\n<p><span class=\"hidden_text\">B.A.No.1089\/08                   3<\/span><\/p>\n<p>entitled to probe into the question why and under what<\/p>\n<p>circumstances the petitioner has imported the vehicle into India.<\/p>\n<p>      5.    Having considered all the relevant inputs,       I am<\/p>\n<p>satisfied that there are no features in this case which would<\/p>\n<p>justify invocation of the extraordinary equitable discretion under<\/p>\n<p>Section 438 Cr.P.C.      This, I agree with the learned Public<\/p>\n<p>Prosecutor, is a fit case where the petitioner must appear before<\/p>\n<p>the investigating officer or the learned Magistrate having<\/p>\n<p>jurisdiction and then seek regular bail in the normal and<\/p>\n<p>ordinary course.\n<\/p>\n<p>      6.    In the result, this petition is dismissed.
