Kodekar, learned APP waives service of notice of rule on<br \/>\nbehalf of the respondent State. With the consent of the learned<br \/>\nadvocates for the parties, the application is taken up for final<br \/>\nhearing today.\n<\/p>\n<p>2.\tAll<br \/>\nthese applications are treated as  Special Criminal Applications by<br \/>\nthe registry. Application\/complaint through complaint box was sent by<br \/>\none of the prisoner kept in Sabarmati Central Jail, Ahmedabad<br \/>\naddressed to the Hon&#8217;ble Chief Justice,High Court of Gujarat,<br \/>\nAhmedabad making a serious and shocking allegations with respect to<br \/>\nthe state of affairs in the Sabarmati Central Jail, Ahmedabad. The<br \/>\nsame was registered as Special Criminal Application No. 1857 of 2008.<br \/>\nSomewhat similar allegations are made with respect to the state of<br \/>\naffairs in the Sabarmati Central Jail, Ahmedabad by some of the<br \/>\nprisoner. They were submitted the complaint through complaint box and<br \/>\nsame is registered as Special Criminal Application No. 1858 of 2008.\n<\/p>\n<p>\tSpecial<br \/>\nCriminal Application No. 1859 of 2008 is also registered pursuant to<br \/>\nthe complaint made by the some of the convict \/ prisoner who are in<br \/>\nSabarmati Central Jail, Ahmedabad.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe nature of serious allegations with respect to the state of<br \/>\naffairs in Sabarmati Central Jail, Ahmedabad vide order dated<br \/>\n18.9.2008 this Court called upon the respondents No. 2 and 3  Jail<br \/>\nSuperintendent, Sabarmati Central Jail, Ahmedabad as well as  I.G.<br \/>\nPrison, Ahmedabad to submit the report considering the allegations in<br \/>\nthe complaint. The report dated 23.9.2008 has been submitted by the<br \/>\nJail Superintendent, Ahmedabad along with the statements of some of<br \/>\nthe prisoners in the Central Jail, however, from the report it<br \/>\nappears that the Jail Superintendent, Sabarmati Central Jail,<br \/>\nAhmedabad has stated that false allegations are made by some of the<br \/>\nprisoners to malign the jail administration. Considering the nature<br \/>\nof the serious allegations with respect to the state of affairs in<br \/>\nthe Sabarmati Central Jail, Ahmedabad,if it is found that there are<br \/>\nsome substance in the same, they are very shocking and which cannot<br \/>\nbe permitted, this Court is of the opinion let the allegations and<br \/>\ncomplaint made in  all the three applications be inquired into and<br \/>\ninvestigated by the D.C.P. Crime, Ahmedabad and submit the report<br \/>\nbefore this Court within a period of three months from today.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, present applications are disposed of by directing<br \/>\nthe D.C.P. Crime, Ahmedabad to inquire into and investigate with<br \/>\nrespect to the allegations made in the present applications with the<br \/>\nassistance of Inspector General of Prisoner, State of Gujarat,<br \/>\nAhmedabad and submit the report within a period of three months from<br \/>\ntoday. Inquiry should be concluded within a period of three months.<br \/>\nAfter conclusion of the inquiry \/ investigation, the concerned<br \/>\nofficer of the D.C.P. Crime, Ahmedabad is directed to submit the<br \/>\nreport before this Court in the present application but not later<br \/>\nthan three months from the date of this order. As and when, such a<br \/>\nreport is submitted by the concerned superior officer of the D.C.P.<br \/>\nCrime in a seal cover in the present proceedings, through the learned<br \/>\nA.P.P, Registry is directed to place the same before this Court so<br \/>\nthat further direction, if any, can be issued.
