Mishra, learned counsel for respondents no.2 and 3 and Sri Sita Ram<br \/>\nVishwakarma, learned counsel for respondent no.4.\n<\/p>\n<p>By this petition, the petitioners have prayed for quashing of the allotment<br \/>\norder dated 24.6.2008 by which allotment was made in favour of respondent<br \/>\nno.4.\n<\/p>\n<p>The petitioners&#8217; case in the writ petition is that the petitioners are the resident<br \/>\nof Vaishali Colony, which colony is developed by the Ghaziabad<br \/>\nDevelopment Authority. It is stated that in Sector II-B there are residential<br \/>\narea and a big ground was lying vacant in between the water tank pumping<br \/>\nhouse and electricity substation building. It is alleged that ground is a green<br \/>\nbelt area which was left for garden\/park area. It is stated that in the master<br \/>\nplan the said area is shown as the green belt. The various representations in<br \/>\nthis context were made by the petitioners to the Vice-Chairman on 26.12.2003<br \/>\nand 23.3.2009 objecting to use of area for any other purposes except<br \/>\npark\/green belt.\n<\/p>\n<p>Sri Shambhu Chopra, learned counsel for the petitioners submits that the area<br \/>\nwhich comes within the ambit of green belt, cannot be used for any other<br \/>\npurposes. He has placed reliance on the cases of <a href=\"\/doc\/1460318\/\">Banglore Medical Trust v.<br \/>\nB.S. Muddappa,<\/a> reported in (1991) 4 SCC 54 and <a href=\"\/doc\/847706\/\">Dr.G.N.Khajuria and<br \/>\nothers v. Delhi Development Authority and others<\/a>, reported in 1995 S.C.C.<br \/>\n(5) 762.\n<\/p>\n<p>Sri V.B. Mishra, learned counsel for the Ghaziabad Development Authority<br \/>\nsubmits that the plot allotted to respondent no.4 was never in green belt area<br \/>\nand the allotment is perfectly justified.\n<\/p>\n<p>Sri Sita Ram Vishwakarma, learned counsel for respondent no.4 has also<br \/>\nsupported the arguments of Sri V.B. Mishra.\n<\/p>\n<p>We have considered the arguments of the learned counsel for the parties and<br \/>\nperused the record.\n<\/p>\n<p>The issues which have been raised in the writ petition are the issues of facts<br \/>\nwhich have to first gone into by the authorities competent in this regard. The<br \/>\n question as to whether the plot which has now been allotted to respondent<br \/>\nno.4 was earmarked in the master plan as green belt for the purpose of<br \/>\ndevelopment of park is the question which has to be examined and decided<br \/>\nafter getting relevant material including master plan and others relevant<br \/>\nmaterial regarding green belt area. The ends of justice be served in giving<br \/>\nliberty to the petitioners to submit a detailed representation to the Chairman,<br \/>\nGhaziabad Development Authority within four weeks from today annexing all<br \/>\nrelevant materials in support of his claim. The Chairman, Ghaziabad<br \/>\nDevelopment Authority may call for relevant records from the Development<br \/>\nAuthority and after giving opportunity to the petitioners and respondent no.4<br \/>\nmay take appropriate decision in this regard.\n<\/p>\n<p>The Chairman, Ghaziabad Development Authority, Ghaziabad shall consider<br \/>\nand take decision expeditiously preferably within a period of two months<br \/>\nfrom the date a copy of the order and representation is filed before him. To<br \/>\nprotect the interest of the petitioners, we further provide that till the decision<br \/>\nis taken by the Chairman, Ghaziabad Development Authority, the status-quo<br \/>\nas it exists today shall be maintained.\n<\/p>\n<p>With the above observations, the writ petition is finally disposed of.\n<\/p>\n<p>Order Date :- 3.8.2010<br \/>\nsks\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Kulomani Pant &amp;
