SIRI JAGAN, J\n               ...............................................\n                 W.P(C) No. 27730 of 2009\n              .................................................\n          Dated this the 5th day of October, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      The petitioner is the Manager of a private educational<\/p>\n<p>institution. The institution has an electricity connection. They<\/p>\n<p>are aggrieved by Exts.P1 ans P2 orders, by which electricity<\/p>\n<p>charges have been demanded from them under LT VII A tariff.<\/p>\n<p>According to the petitioner, the petitioner is liable to pay<\/p>\n<p>electricity charges only under LT VI A tariff. They also rely on<\/p>\n<p>the decision of this court in <a href=\"\/doc\/570725\/\">Bro.Joseph Antony v. KSEB<\/a> [2009<\/p>\n<p>(3) KLT 1022], wherein a Division Bench of this court has held<\/p>\n<p>that private educational institutions are liable to be classified<\/p>\n<p>only under LT VI A tariff for electricity charges.<\/p>\n<p>      2. I have heard the standing counsel appearing for the<\/p>\n<p>KSEB also.\n<\/p>\n<p>      3. In view of the said decision, the petitioner is entitled to<\/p>\n<p>succeed in this writ petition. Accordingly, Ext.P2 is quashed. It<\/p>\n<p>is declared that the petitioner is liable to pay electricity charges<\/p>\n<p>only under LT VIA tariff. Excess amount paid by the petitioner<\/p>\n<p><span class=\"hidden_text\">W.P(C) No. 27730 of 2009         -2-<\/span><\/p>\n<p>under LT VII A tariff shall be adjusted against future bills of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      The writ petition is allowed as above.\n<\/p>\n<\/p>\n<p>                                        S.
