(J)\n\nCITATION:\n 1987 AIR  242\t\t  1987 SCR  (1) 379\n 1987 SCC  (1) 180\t  JT 1986  1068\n 1986 SCALE  (2)996\n\n\nACT:\n    Tamilnadu  Buildings (Lease and Rent Control) Act  1960,\ns.10(2)(ii)(a)-Eviction\t on the ground of  unlawful  sublet-\nting--Such  sub-letting must be by the tenant sought  to  be\nevicted and not by his predecessor.\n\n\n\nHEADNOTE:\n    The\t appellant-landlord instituted an eviction  suit  in\n1970 against the respondent-tenant on the ground of unlawful\nsubletting.  The respondent had inherited the  tenancy\tupon\nthe death of his father in 1968. The subletting was created,\nin  1952 during the life time of appellants father.  Neither\nthe appellant, nor the respondent had any personal knowledge\nabout  the  terms  and conditions of  the  lease  originally\ngranted\t by  the father of the appellant in  favour  of\t the\nfather of the respondent.\n    The\t High  Court,  while dismissing the  appeal  of\t the\nappellant-landlord, held that a tenant sought to be  evicted\non the ground of unlawful subletting under s.10(2)(ii)(a) of\nthe Tamil Nadu Buildings (Lease and Rent control) Act,\t1960\nmust himself have been guilty of the contravention and\tthat\nthe alleged contravention by his father when he was a tenant\ncan be of no avail for evicting the tenant.\nDismissing the Appeal of the appellant-landlord, this Court,\n    HELD:  1(i)\t Section  10(2) of the Act  opens  with\t the\nwords,\t\"a landlord who seeks to evict his tenant\" and\tpro-\nvides  that if the tenant has created a\t subtenancy  without\nthe written consent of the landlord, he will he liable to be\nevicted.  When the statute says the tenant who is sought  to\nhe  evicted must he guilty of the contravention,  the  Court\ncannot\tsay,  \"guilt of his predecessor\t in  interest\"\twill\nsuffice. [382C-D]\n    (ii)  The  flouting of the law, the sin under  the\tRent\nAct, must he the sin of the tenant sought to be evicted\t and\nnot that of his father or predecessor in interest. It  being\na  penal provision in the sense that it visits the  violator\nwith  the punishment of eviction, it must he  strictly\tcon-\nstrued, for it causes less misery to be sheltered in a jail,\nthan to be shelterless without. [382E]\nIn the instant case, there is nothing on record to show that\nthe subletting\n380\nwhich  was made in 1952,18 years before the  institution  of\nthe eviction suit in 1970, was in violation of the  relevant\nprovisions  of law. There is no evidence, direct or  circum-\nstantial,  on  the basis of which it can be  said  that\t the\nlease  did  not confer on the father of the  respondent\t the\nright  to create a sub-tenancy, or that it was done  without\nthe written consent of the then landlord, the father of\t the\nappellant.  Under these circumstances, the appellant  cannot\nsuccessfully  evict the respondent on the ground  of  having\ncreated\t an  unlawful  sub-tenancy  within  the\t meaning  of\nS.10(2)(ii)(a) of the Act. No. 1066 of 1972.<br \/>\nK. Ramkumar for the Appellant.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    THAKKAR,  J.  The view taken by the High  Court  that  a<br \/>\ntenant\tsought to be evicted on the ground of unlawful\tsub-<br \/>\nletting under Section 10(2)(ii)(a)1 of the Tamil Nadu Build-<br \/>\nings  (Lease and Rent Control) Act, 1960 must  himself\thave<br \/>\nbeen  guilty of the contravention and that the alleged\tcon-<br \/>\ntravention  by his father when he was a tenant can be of  no<br \/>\navail for evicting him is assailed in this appeal by special<br \/>\nleave.\tThe High Court has so pronounced in the backdrop  of<br \/>\nthe  admitted fact that respondent had himself\tnot  created<br \/>\nany sub-tenancy after he became the tenant in 1968 upon\t the<br \/>\ndeath  of his father. The plea raised by the appellant\tthat<br \/>\nthe  tenancy  created in 1952 by the  father  of  respondent<br \/>\nrendered him liable to be evicted in the suit instituted  by<br \/>\nthe  appellant in 1970 was repelled. The unsuccessful  land-<br \/>\nlord has now invoked this Court&#8217;s jurisdiction under Article<br \/>\n136 of the Constitution of India.\n<\/p>\n<p>Facts not in dispute are:&#8211;\n<\/p>\n<p>1. The father of the appellant had granted a lease in favour<br \/>\nof the\n<\/p>\n<p>1.  &#8220;10(2) &#8221;  A landlord who seeks to evict his tenant shall<br \/>\napply  to the Controller for a direction in that behalf.  If<br \/>\nthe Controller, after giving the tenant a reasonable  oppor-<br \/>\ntunity\tof showing cause against the application, is  satis-<br \/>\nfied-\n<\/p>\n<p>\t      (i) xxx  xxxx\n<\/p>\n<p>\t      (ii) that the tenant has after the 23rd  Octo-<br \/>\nber, 1945 without the written consent of the landlord&#8211;\n<\/p>\n<p>   (a)\ttransferred his right under the lease or sub-let the<br \/>\nentire\tbuilding or any portion thereof, if the\t lease\tdoes<br \/>\nnot confer on him any right to do so, or<br \/>\nX X X X XXXXX&#8221;\n<\/p>\n<p><span class=\"hidden_text\">381<\/span><\/p>\n<blockquote><p>\t      father of respondent prior to 1952 (the  exact<br \/>\n\t      date or year is not on record).\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t2.  The father of the  appellant  as<br \/>\n\t      also the father of respondent both have died.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t3.  Respondent\twas  accepted  as  a<br \/>\n\t      tenant upon the death of his father in 1968.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t4. The suit for eviction giving rise<br \/>\n\t      to  the  present\tappeal\twas  instituted\t for<br \/>\n\t      eviction on the ground of unlawful  subletting<br \/>\n\t      in 1970 by the appellant who had inherited the<br \/>\n\t      property from her father.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t5. Admittedly, neither the appellant<br \/>\n\t      nor the respondent have any personal knowledge<br \/>\n\t      about  the terms and conditions of  the  lease<br \/>\n\t      originally granted by the father of the appel-<br \/>\n\t      lant in favour of the father of respondent no.\n<\/p><\/blockquote>\n<blockquote><p>\t      1.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t6. So also neither the appellant nor<br \/>\n\t      the respondent have any personal knowledge  in<br \/>\n\t      what circumstance the father of the respondent<br \/>\n\t      had   created  a\tsub-tenancy  in\t favour\t  of<br \/>\n\t      Kuppuswami  Sah  way back\t in  1952,  eighteen<br \/>\n\t      years before the institution of the suit.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t7.  Neither  the appellant  nor\t re-<br \/>\n\t      spondent\thas  any personal  knowledge  as  to<br \/>\n\t      whether  or  not the sub-tenancy\twas  created<br \/>\n\t      with  the\t written  consent  of  the  landlord<br \/>\n\t      eighteen years back in 1952.\n<\/p><\/blockquote>\n<p>And  on these facts the prayer for eviction must  be  denied<br \/>\nregardless  of the question of interpretation which will  be<br \/>\npresently  tackled.  The mere fact that for as\tmany  as  18<br \/>\nyears no objection was raised, and no action for  possession<br \/>\nwas  instituted against the father of the appellant  in\t his<br \/>\nlifetime  notwithstanding  the fact that  a  sub-tenant\t was<br \/>\nopenly in occupation of a part of the rented premises, would<br \/>\ngive  rise  to\tan inference that it was  never\t treated  as<br \/>\nunlawful  sub-letting by the appellant or her father.  There<br \/>\nis  nothing on record to show that the subletting  in  ques-<br \/>\ntion,  which was made in 1952, 18 years before the  institu-<br \/>\ntion  of the suit in 1970, was in violation of the  relevant<br \/>\nprovisions  of law. The appellant cannot succeed unless\t the<br \/>\nappellant  establishes\tthat Section 10(2)(ii)(a)  has\tbeen<br \/>\nviolated  and  the tenant has incurred the liability  to  be<br \/>\nevicted on the ground of unlawful sub-letting  notwithstand-<br \/>\ning  the fact that the lease did not confer on him any\tsuch<br \/>\nright, and that such unlawful sub-tenancy was created  with-<br \/>\nout the<br \/>\n<span class=\"hidden_text\">382<\/span><br \/>\nwritten consent of the then landlord. There is no  evidence,<br \/>\ndirect\tor circumstantial, on the basis of which it  can  be<br \/>\nsaid  that  the lease did not confer on the  father  of\t the<br \/>\nrespondent the right to create a sub-tenancy. Or that it was<br \/>\ndone without the written consent of the then landlord,\tthat<br \/>\nis  to say, the father of the appellant. Under\tthe  circum-<br \/>\nstances,  in  any view of the matter  the  appellant  cannot<br \/>\nsuccessfully  evict the respondent on the ground  of  having<br \/>\ncreated\t an unlawful sub-tenancy within the meaning of\tSec-<br \/>\ntion 10(2)(ii)(a) of the Act.\n<\/p>\n<p>    Examining  the  profile of the view taken  by  the\tHigh<br \/>\nCourt  that the offending sub-letting must be by the  tenant<br \/>\nsought to be evicted himself, and not by his predecessor, it<br \/>\nappears\t to  be blemishless. Section 10(2)  opens  with\t the<br \/>\nwords  &#8220;A landlord who seeks to evict his tenant&#8221;  and\tpro-<br \/>\nvides  that if the tenant has created a sub-tenancy  without<br \/>\nthe written consent of the landlord, he will be liable to be<br \/>\nevicted. Pray who is the &#8216;tenant&#8217; whom the landlord wants to<br \/>\nevict? That tenant is the respondent. Did he violate Section<br \/>\n10(2)(ii)(a) and sub,let the rented premises? The answer  is<br \/>\n&#8216;no&#8217;.  It is of little use to give the answer, not  he,\t but<br \/>\nhis predecessor, his late father, had sub-let the  premises.<br \/>\nWhen the statute says the tenant who is sought to be evicted<br \/>\nmust  be guilty of the contravention, the Court cannot\tsay,<br \/>\n&#8216;guilt\tof  his predecessor in interest&#8217; will  suffice.\t The<br \/>\nflouting of the law, the sin under the Rent Act must be\t the<br \/>\nsin of the tenant sought to be evicted, and not that of\t his<br \/>\nfather or predecessor in interest. Respondent inherited\t the<br \/>\ntenancy, not the sin, if any, of his father. The law in\t its<br \/>\nwisdom\tseeks to punish the guilty who commits the sin,\t and<br \/>\nnot  his  son who is innocent of the rent  law\toffence.  It<br \/>\nbeing  a  penal provision in the sense that  it\t visits\t the<br \/>\nviolator with the punishment of eviction, it must be strict-<br \/>\nly construed, for it causes less misery to be sheltered in a<br \/>\njail, than to be shelterless without. Be that as it may\t the<br \/>\nconclusion recorded by the High Court is fault-free.<br \/>\n    We, therefore, see no reason to interfere with the order<br \/>\nof  the\t High Court in exercise of  our\t jurisdiction  under<br \/>\nArticle 136 of the Constitution of India. The appeal accord-<br \/>\ningly  fails and is dismissed.
