By the impugned  judgment<br \/>\nthe  second  appeal filed by him has been dismissed  by\t the<br \/>\nHigh   Court  at  the  admission   stage  finding  that\t  no<br \/>\nsubstantial question of law is involved.  The facts in brief<br \/>\nare as follows:\n<\/p>\n<p>    A  petition\t for eviction on various grounds  was  filed<br \/>\nagainst\t the  appellant\t in the year 1979.   The  ground  of<br \/>\neviction  relevant for the present purposes is only the bona<br \/>\nfide need of the respondents under clause (h) of sub-section<br \/>\n(1) of Section 13 of the Rajasthan Premises (Control of Rent<br \/>\nand Eviction) Act, 1950.  Under the said provision the Court<br \/>\non being satisfied that the premises are required reasonably<br \/>\nand  bona fide by the landlord for the use or occupation  of<br \/>\nhimself\t or his family members could pass a decree in favour<br \/>\nof  the\t landlord directing the eviction of the tenant.\t  In<br \/>\nthe  present case, a decree for eviction was passed  against<br \/>\nthe  appellant\ton  12th February, 1986.  The  first  appeal<br \/>\nfiled  by  the\tappellant  was dismissed  by  an  Additional<br \/>\nDistrict  Judge\t on 6th May, 1993.  The decree of the  trial<br \/>\ncourt  and  the order in appeal were, however, set aside  by<br \/>\nthe  High Court in second appeal preferred by the appellant.<br \/>\nIn terms of the decision dated 21st December, 1993, the High<br \/>\nCourt,\tinter alia, noticed that one of the grounds taken by<br \/>\nthe  tenant  that  another  house   was\t available  for\t the<br \/>\nresidence  of the respondents and the said house had come in<br \/>\ntheir occupation after the decision of the suit by the trial<br \/>\ncourt  had  not\t been  considered.  In this  view  and\talso<br \/>\nkeeping\t in  view the fact that counsel for the\t respondents<br \/>\ndid  not  dispute  that\t the appellant was  entitled  to  be<br \/>\ngranted\t an  opportunity to amend the written  statement  so<br \/>\nthat the subsequent events can be brought on record, setting<br \/>\naside  the judgment and decree of the courts below, the High<br \/>\nCourt  remanded\t the  case for fresh decision of  the  trial<br \/>\ncourt  directing  the trial court to allow the appellant  to<br \/>\namend  the  written  statement\tto   bring  on\trecord\t the<br \/>\nsubsequent  events of construction of a house and same being<br \/>\navailable  to the respondents\/their father and other  family<br \/>\nmembers and to allow the respondents to file replication, if<br \/>\nany,  to  the amended written statement to be filed  by\t the<br \/>\nappellant and to decide the matter afresh after allowing the<br \/>\nparties to lead additional evidence on this point and taking<br \/>\ninto  consideration the evidence already recorded during the<br \/>\ntrial.\t After\tremand two additional issues were framed  by<br \/>\nthe trial court which read as under:\n<\/p>\n<p>    Issue  No.1-A:  Whether, after construction of the house<br \/>\nbearing\t No.53-A,  Ranjit Nagar, Bharatpur by the mother  of<br \/>\nthe  plaintiffs,  the plaintiffs have no requirement of\t the<br \/>\ndisputed  Nauhra to get the same vacated in good faith,\t and<br \/>\non  this  ground  the suit of the plaintiffs is\t fit  to  be<br \/>\ndismissed?\n<\/p>\n<p>    Issue   No.8-A:   Whether  in   view  of  the  statement<br \/>\ncontained in para No.8 of the written statement filed during<br \/>\nthe  pendency  of the suit, the plaintiffs are left with  no<br \/>\nrequirement of the suit premises?\n<\/p>\n<p>    The trial court on consideration of the matter afresh by<br \/>\njudgment  and  decree dated 19th December, 1996, inter\talia<br \/>\nheld  that  the respondents have 27 members of their  family<br \/>\nand  there  are\t only 13 rooms available to  them  and\tthey<br \/>\nrequire\t the  premises\tin dispute in good faith  for  their<br \/>\nresidential  use.  The plea that after construction of House<br \/>\nNo.53-A\t in  Mohalla  Ranjit  Nagar by\tthe  mother  of\t the<br \/>\nrespondents  they  were\t left  with no\trequirement  of\t the<br \/>\ndisputed  house\t was  negatived.  The issue  of\t comparative<br \/>\nhardship  was  also  decided in favour\tof  the\t respondents<br \/>\nholding\t that  the  appellant is not likely  to\t suffer\t any<br \/>\nhardship  if  the disputed premises is got vacated from\t him<br \/>\nand  that  the\trespondents shall suffer  more\thardship  in<br \/>\ncomparison  to the appellant if the disputed premises is not<br \/>\nvacated\t by  the appellant.  The judgment and decree of\t the<br \/>\ntrial  court was affirmed in appeal by the learned  District<br \/>\nJudge in terms of the judgment dated 17.12.1999.  The second<br \/>\nappeal\thaving\tbeen  dismissed, the tenant  has  filed\t the<br \/>\npresent\t appeal.  The litigation has already taken nearly 21<br \/>\nyears.\n<\/p>\n<p>    Having  heard learned counsel for the parties, we do not<br \/>\nfind  any  ground to interfere with the concurrent  findings<br \/>\nrecorded  by  all  the\tcourts.\t  Dr.Rajiv  Dhawan,  learned<br \/>\ncounsel\t for the appellant, however, contends that it was  a<br \/>\ncase  of an open remand in terms of the decision of the High<br \/>\nCourt dated 21st December, 1993 and has been wrongly treated<br \/>\nas  a  case  of limited remand by the trial court.   On\t the<br \/>\nfacts  and circumstances of the case it is not necessary  to<br \/>\ngo  into this aspect.  We would assume that it was a case of<br \/>\nopen  remand to reconsider afresh the ground of eviction for<br \/>\nthe  personal need of the respondents.\tEven so we find that<br \/>\non  consideration  of the evidence, the trial court  rightly<br \/>\ndecreed\t the  suit.   There is also no merit  in  the  other<br \/>\ncontention  that  comparative hardship aspect has  not\tbeen<br \/>\ntaken  into  consideration by the trial court.\t As  already<br \/>\nnoticed, the trial court has held that the respondents shall<br \/>\nsuffer\tmore hardship in comparison to the appellant in case<br \/>\nthe  disputed premises is not vacated by the appellant.\t  We<br \/>\nfind no ground to interfere with the said findings.\n<\/p>\n<p>    There  is  no  ground  to interfere\t with  the  impugned<br \/>\njudgment.    However,  having  regard  to  the\t facts\t and<br \/>\ncircumstances  of the case, the time to vacate the  premises<br \/>\nis  extended upto 31st December, 2001 instead of 30th  June,<br \/>\n2001  as granted to the appellant by the High Court  subject<br \/>\nto  the\t appellant&#8217;s filing usual undertaking in this  Court<br \/>\nwithin a period of four weeks.\n<\/p>\n<p>    Subject  to the above variation, the appeal is dismissed<br \/>\nleaving the parties to bear their own costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Babu Lal vs Vinod Kumar &amp; Anr on 1 November, 2000 Author: Y.K.Sabharwal Bench: D.P.
