Bundela, Scientist-E &amp; Lt Col K.\n                              Sudhakar, Estate Manager)\n\nDate of Hearing       :       17.11.2009\n\nDate of Decision :            17.11.2009\n\nFACTS<\/pre>\n<p> :\n<\/p>\n<p>      By his letter of 2.2.2009, the appellant had sought information<br \/>\non 05 paras regarding Appollo DRDO Hospital at Hyderabad. The<br \/>\nCPIO had refused to disclose information vide letter dated 19.3.2009<br \/>\non the ground that DRDO is an exempted organisation. The<br \/>\nAppellate Authority had disposed of the first appeal vide order dated<br \/>\n12.5.2009. The operative para thereof is reproduced below :-<br \/>\n&#8220;(a) Copy of amended second schedule is enclosed.\n<\/p>\n<p>(b) Your application dated 02 Feb 2009 was received at HQ on 11<br \/>\n      Fev 2009. The same forwarded to many agencies to get the<br \/>\n      relevant information these replies were reviewed by this HQ<br \/>\n      and suitable reply was forward to you on 19 Mar 2009.\n<\/p>\n<p>(c) As per records, AHEL is not a joint venture and no<br \/>\n      direct\/indirect funding from any Govt. authority\/DRDO is<br \/>\n      being given for running the hospital. The building and<br \/>\n      infrastructure facilities are only provided by DRDO. Apollo-<br \/>\n      DRDO hospital maintains its own accounts and patient data<br \/>\n      and DRDO does not have any role in this regard.&#8221;\n<\/p>\n<p>2.   The present appeal is directed against the orders of the<br \/>\nCPIO\/AA.\n<\/p>\n<p>3.    Heard on 17.11.2009. Appellant not present. The public<br \/>\nauthority is represented by the officers named above. I am of the<br \/>\nopinion that even though the DRDO is an exempt organisation u\/s 24<br \/>\nof the RTI Act, the information sought by the appellant is not<br \/>\nexempted from disclosure. The Appellate Authority has, therefore,<br \/>\nwisely disclosed some information to the appellant vide letter referred<br \/>\nto above. During the hearing Col Sudhakar would submit that DRDO<br \/>\nhas given the hospital and residential buildings to the Appollo<br \/>\n Hospital on lease cum licence basis and it has no role in the<br \/>\nmanagement of the hospital.\n<\/p>\n<p>                        INTERIM DECISION\n<\/p>\n<p>4.    Col K.Sudhakar is directed to provide the following<br \/>\ninformation to the Commission :-\n<\/p>\n<p>(i)   copy of the order regarding the construction of the hospital<br \/>\n      premises and other connected buildings presently leased out to<br \/>\n      AHEL;\n<\/p>\n<p>(ii) total amount spent on the construction;\n<\/p>\n<p>(iii) annual licence fee being paid by AHEL to DRDO.\n<\/p>\n<p>(iv) nature of facilities being provided by AHEL to the DRDO<br \/>\n      officers and staff.\n<\/p>\n<p>5.
