GOVERNMENT PLEADER for\nRespondent(s) : 1 - 2. \nMR SK PATEL for Respondent(s) : 3, \nMS\nROOPAL R PATEL for Respondent(s) :\n3, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/03\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npetitioner has prayed to hold and declare that the first requirement<br \/>\nof Mast&#8217;s degree in second class of a recognized university is<br \/>\narbitrary and illegal and to declare that the academic qualification<br \/>\nfor the post of Principal should be at par with the academic<br \/>\nqualification of the Principal as prescribed for the Government<br \/>\nSecondary Schools or as per Regulation 20 of the Secondary Education<br \/>\nRegulations,1974.\n<\/p>\n<p>2.\t\tAccording<br \/>\nto the petitioner he is B.Sc, B.Ed., and M.Ed having 13 years of<br \/>\nexperience in teaching line. The petitioner was serving as Principal<br \/>\nof  in a private secondary school. In pursuance of an advertisement<br \/>\ninviting application for filling up the post of Principal of Adivasi<br \/>\nNivasi School, the petitioner has applied for the said post. However,<br \/>\nthe petitioner received a letter  stating that he was not selected<br \/>\nfor interview on account of not possessing the prescribed educational<br \/>\nqualifications. According to the petitioner,  there was no reason to<br \/>\nreject the application of the petitioner and therefore he has<br \/>\nchallenged the rejection order. He has also challenged the  rules<br \/>\nrequiring a candidate possessing Master&#8217;s degree in second class of a<br \/>\nrecognized university as qualification.\n<\/p>\n<p>3.\t\tAccording<br \/>\nto the petitioner he possesses requisite qualification and the<br \/>\nqualification prescribed in the rules are illegal and arbitrary. The<br \/>\nargument is that whether a Principal is of a Government secondary<br \/>\nschool or private secondary school, the requirement is to have a<br \/>\ndegree of trained graduate in education, or any other equivalent<br \/>\ndegree declared by the State Government and it requires further<br \/>\nteaching experience of five years and three years.\n<\/p>\n<p>4.\t\tHowever,<br \/>\nit is required to be noted that  in exercise of powers conferred<br \/>\nunder the Constitution of India, the Governor of Gujarat made rules<br \/>\nto provide for regulating recruitment to the post of Principal,<br \/>\nClass-II at Government Residential Schools for Scheduled Casts and<br \/>\nSocially and Educationally Backward Classes. According to these<br \/>\nrules, to be eligible for appointment by direct selection to the<br \/>\npost mentioned in Rule 2, a candidate should possess a Second Class<br \/>\nMaster&#8217;s degree of a recognised University.  The petitioner did not<br \/>\npossess this qualification. It is the absolute  discretion of the<br \/>\nrule making authority to consider and fix the criteria on certain<br \/>\nposts and the petitioner cannot be heard upon to say that some<br \/>\nparticular rules are illegal or arbitrary merely because they do not<br \/>\nfavour a particular individual.\n<\/p>\n<p>5.\t\tFurther<br \/>\nit is required to be noted that  the notification dated 9th<br \/>\nJuly1991 on which reliance is placed by the petitioner is already<br \/>\nmodified and therefore the petitioner cannot now take advantage of<br \/>\nthe said Circular.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\npetition is, therefore, dismissed.
