ANUJ KUMAR SHRIVASTAVA<br \/>\n                                ***********<\/p>\n<p>2     02\/06\/2011             Heard Counsel for the petitioner, the informant<\/p>\n<p>                    and the A.P.P. appearing on behalf of the State.<\/p>\n<p>                              The petitioners are accused in a case under<\/p>\n<p>                    Section 302\/34 of the Indian Penal Code. In connection<\/p>\n<p>                    with the case, he has remained in custody since<\/p>\n<p>                    24.01.2011.\n<\/p>\n<p>                             In the First Information Report, there is an<\/p>\n<p>                    specific allegation that Ajit Rai fired at the deceased,<\/p>\n<p>                    which resulted in his death.\n<\/p>\n<p>                             Learned Counsel for the petitioners referred to<\/p>\n<p>                    the order dated 27.04.2011 passed in Criminal Misc. No.<\/p>\n<p>                    12133 of 2011 by which the similarly situated co-accused<\/p>\n<p>                    person, namely, Dhananjay Ray has been granted bail by<\/p>\n<p>                    this Court.\n<\/p>\n<p>                             Counsel for the informant refers to the order of<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        the Court below to submit that the Court below has<\/p>\n<p>        referred to several paragraphs of the case diary while<\/p>\n<p>        rejecting the prayer for bail of the petitioners.<\/p>\n<p>                  On perusal of the order, I find that the Court<\/p>\n<p>        below has held that all the witnesses at paragraphs 34,<\/p>\n<p>        35, 36 and 37 have supported the case of the prosecution<\/p>\n<p>        and stated that the petitioner along with others was<\/p>\n<p>        present as a member of the mob during the occurrence.<\/p>\n<p>                  This aspect of the matter has been considered<\/p>\n<p>        by this Court while granting bail to Dhananjay Ray in<\/p>\n<p>        Criminal Misc. No. 12133 of 2011. Therefore, I see no<\/p>\n<p>        reason to distinguish the case of these petitioners with<\/p>\n<p>        the case of Dhananjay Ray.\n<\/p>\n<p>                  Accordingly, the above named two petitioners<\/p>\n<p>        are directed to be released on bail in Natwar Police<\/p>\n<p>        Station Case No. 08 of 2011 on furnishing bail bonds of<\/p>\n<p>        Rs. 10,000\/- (ten thousand) each with two sureties of the<\/p>\n<p>        like amount each to the satisfaction of the Sub Divisional<\/p>\n<p>        Judicial Magistrate, Bikramganj, Rohtas.<\/p>\n<pre>Anand                                         ( Sheema Ali Khan, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Munna Rai @ Munna Roy vs The State Of Bihar on 2 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
