NO. 4464 OF 2004\n\n                     ---------------------------------------\n\n                   Dated this the 12th day of July, 2007.\n\n\n                                 J U D G M E N T\n<\/pre>\n<p>      This writ petition is filed mainly with the following prayers:\n<\/p>\n<blockquote><p>             i)        issue a writ of certiorari or other appropriate writ<\/p>\n<p>             order   or   direction,   calling   for   the   records   leading   to<\/p>\n<p>             Exhibit P5 and declare the same to be illegal and quash<\/p>\n<p>             the   same,   to   the   extent   it  does   not   fix   the   pensionary<\/p>\n<p>             benefits   to   the   petitioner,   based   on   the   pay   scale<\/p>\n<p>             reckoning   the   period   of   training   rendered   after<\/p>\n<p>             appointment to the post of Sub Inspector of Police.<\/p>\n<\/blockquote>\n<blockquote><p>             ii)       issue   a   writ   of   mandamus   or   other   appropriate<\/p>\n<p>             writ   order   or   direction   directing   the   respondents   to<\/p>\n<p>             reckon   the   period   of   training   of   the   petitioner   after<\/p>\n<p>             joining   the   post   of   S.I.   of   Police   and   to   give   him   all<\/p>\n<p>             consequential benefits pursuant thereto.<\/p>\n<\/blockquote>\n<blockquote><p>             iii)      issue   a   writ   of   mandamus   or   other   appropriate<\/p>\n<p>             writ or order directing the respondents to accept the re-<\/p>\n<p>             option   submitted   by   the   petitioner   in   respect   of   1988<\/p>\n<p>             and   1992   pay   revisions   and   to   grant   the   petitioner   all<\/p>\n<p>             consequential benefits.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>      2.  It is submitted that the issue is covered in favour of the<\/p>\n<p>petitioner   by   the   decision   reported   in  <a href=\"\/doc\/22042819\/\">Lakshmanan   vs.   State   of<\/p>\n<p>Kerala<\/a> (1995(1) KLT 115).  Hence, there will be a direction to the<\/p>\n<p>respondents   to   take   appropriate   action   in   the   case   of   the<\/p>\n<p><span class=\"hidden_text\">W.P. (C). 4464\/04                        2<\/span><\/p>\n<p>petitioner in the light of the above decision, within a period of two<\/p>\n<p>months  from the date of production of a copy of this judgment.\n<\/p>\n<p>Eligible   benefits   also   shall   be   disbursed   to   the   petitioner   within<\/p>\n<p>another one month.\n<\/p>\n<p>       This writ petition is disposed of as above.\n<\/p>\n<p>                                                KURIAN JOSEPH, JUDGE.\n<\/p>\n<p>smp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court U.P.V.
