JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(a)\tIssue<br \/>\na writ of mandamus or a writ in the nature of mandamus or any other<br \/>\nappropriate writ, order or direction directing the Respondents, their<br \/>\nofficers, agent and servants directing the Respondent DEO to transfer<br \/>\nthe Petitioner from the G.M. Patel High School, Nadasa to either of<br \/>\nthe two schools providing Higher Secondary course;\n<\/p>\n<p>(b)\tIssue<br \/>\na writ of mandamus or a writ in the nature of mandamus or any other<br \/>\nappropriate writ, order or direction directing the Respondents, their<br \/>\nofficers, agent and servants directing the Respondent DEO to transfer<br \/>\nthe Petitioner from the G.M. Patel High School, Nadasa to any other<br \/>\nSchool in the city of Ahmedabad out of the 22 school having<br \/>\nvacancies;\n<\/p>\n<p>(c)\tPass<br \/>\nany other necessary order in the interest of justice;&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. Chaitanya S. Joshi, learned advocate for the<br \/>\npetitioner states that the interest of justice would be met, if the<br \/>\npetitioner is permitted to make a fresh representation to respondent<br \/>\nNo.3(District Education Officer) in order to voice the grievances<br \/>\nmade in the petition.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tThe<br \/>\npetitioner is permitted to make a representation to respondent<br \/>\nNo.3(District Education Officer), within a period of 15 days from<br \/>\ntoday.\n<\/p>\n<p>(b)\tIn<br \/>\nthe event that the petitioner makes a representation to respondent<br \/>\nNo.3, within a stipulated period of time, respondent No.3 may<br \/>\nconsider and decide the same, in accordance with law, after giving<br \/>\nthe petitioner an opportunity of personal hearing.\n<\/p>\n<p>(c)\tThe<br \/>\nrepresentation may be decided, as expeditiously as possible, and<br \/>\npreferably within a period of two months from the date of receipt<br \/>\nthereof.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p>\t\t\t\t\t(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Purshottam vs Education on 10 January, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
