The petitioner has approached this Court by<\/p>\n<p>                   filing the present writ petition with the following prayer:<\/p>\n<blockquote><p>                                 &#8220;That this writ application is directed<br \/>\n                       against the illegal construction of Public drain and<br \/>\n                       residential home under the Indira Awas Yojana<br \/>\n                       over the private land of the petitioner. The<br \/>\n                       respondents parties are making a drain of 133 feet<br \/>\n                       into 3 feet, a drain of 120 feet into 3 feet, a drain<br \/>\n                       70 feet into 3 feet. The respondents parties are<br \/>\n                       making two residential home also for Bhikhari<br \/>\n                       Thakur, son of Dhanik Thakur, and Tanik Lal Sah,<br \/>\n                       son of Moti Sah, both resident of village Tetari,<br \/>\n                       Police Station Balia, District Begusarai under the<br \/>\n                       Indira Awas Yojana over the private land of the<br \/>\n                       petitioner while a Title Suit No. 127 of 2002 is<br \/>\n                       pending over that disputed land before the Sub-<br \/>\n                       Judge I, Begusarai.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                             3. In view of the controversy raised in the<\/p>\n<p>                   petition, it would be appropriate that the grievances raised<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>by the petitioner herein be looked into by the respondent-\n<\/p><\/blockquote>\n<p>District Collector, Begusarai. The writ petition was filed as<\/p>\n<p>far back as on 19.05.2003, but till date no stay order was<\/p>\n<p>passed by this Court and in that view of the matter, some<\/p>\n<p>construction might have taken place over the plot in<\/p>\n<p>question. However, learned counsel for the petitioner<\/p>\n<p>submits that construction has not been completed and,<\/p>\n<p>therefore,     the   matter   can   be   adjudicated   by   the<\/p>\n<p>respondent- District Collector, Begusarai. No counter-<\/p>\n<p>affidavit has been filed on behalf of the respondent-<\/p>\n<p>authorities, denying the assertions made by the petitioner.<\/p>\n<p>In that view of the matter also, it is difficult for this Court<\/p>\n<p>to come to a finding about any factual position.<\/p>\n<p>             4. In the circumstances of the case, this writ<\/p>\n<p>petition is disposed of with a liberty to the petitioner to file<\/p>\n<p>a representation before the respondent- District Collector,<\/p>\n<p>Begusarai within a period of one month from today with all<\/p>\n<p>relevant documents in support of his claim over the land in<\/p>\n<p>question. If such a representation is filed along with a copy<\/p>\n<p>of this order, the respondent- District Collector, Begusarai,<\/p>\n<p>would be obliged to decide the issues within a period of<\/p>\n<p>three months thereafter by giving opportunity of hearing to<\/p>\n<p>all concerned.\n<\/p>\n<p>             5. It is made clear that this Court has not gone<\/p>\n<p>into merit of the case as the controversies between the<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>           parties are required to be adjudicated by the respondent-<\/p>\n<p>           District Collector, Begusarai. It is further made clear that if<\/p>\n<p>           the petitioner does not file any representation before the<\/p>\n<p>           District Collector within the time fixed by this Court along<\/p>\n<p>           with a certified copy of this order, then it would be<\/p>\n<p>           construed that this writ petition has stood rejected by this<\/p>\n<p>           Court.
