He further submits that the<br \/>\napplication filed by respondent no.3 before the respondent no.2 &#8211;<br \/>\nSettlement Commissioner is not maintainable under the said provisions<br \/>\nof the Act and therefore, the show cause notice issued by the<br \/>\nSettlement Commissioner dated 31.12.2010 itself is illegal.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above, petitioner seeks permission to withdraw this<br \/>\npetition with liberty to raise all the contentions which are raised<br \/>\nin this petition along with the preliminary contention that the<br \/>\napplication filed by respondent no.3 is not tenable before the<br \/>\ncompetent authority.
