MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nshort question is whether while challenging the award passed by the<br \/>\nLabour Court or the Industrial Court or the Industrial Tribunal,<br \/>\nparticularly in a case where no specific relief is sought for against<br \/>\nthe concerned Labour Court\/Industrial Court\/Industrial Tribunal, the<br \/>\nconcerned  Labour Court\/Industrial Court\/Industrial Tribunal is<br \/>\nrequired to be joined as a party respondent.\n<\/p>\n<p>2.\tIn<br \/>\nthe case of <a href=\"\/doc\/19838\/\">Steel Authority<br \/>\nof India vs. GM Panchayat,<\/a> reported in 2004 (1) GLR 729,<br \/>\nat para 34, a Division Bench of this Court giving reference to the<br \/>\nSupreme Court decision in the case of  <a href=\"\/doc\/1401120\/\">Udit<br \/>\nNarain Singh Malpaharia vs. Additional Member, Board of Revenue,<br \/>\nBihar,<\/a> reported in AIR 1963 SC 786, observed that the<br \/>\nTribunal is not a necessary party where the petition is filed under<br \/>\nArticle 227 of the Constitution of India, but the Tribunal is a<br \/>\nnecessary party where the petition is filed under  Article 226 of the<br \/>\nConstitution of India and appropriate reliefs are claimed.\n<\/p>\n<p>3.\tIn<br \/>\na subsequent decision in the case of <a href=\"\/doc\/762982\/\">Gujarat<br \/>\nState Road Transport Corporation vs. Pravin Joshi,<\/a><br \/>\nreported in 2004 (4) GLR 3379, another Division Bench of this Court<br \/>\nobserved at para 21 that &#8220;Therefore, the question that requires<br \/>\nour consideration is as to whether without joining the Labour Court<br \/>\nas a party in a petition, was the petition not maintainable.  The<br \/>\nobvious answer could be &#8216;no'&#8221;.\n<\/p>\n<p>4.\tThe<br \/>\nlearned Single Judge having noticed the aforesaid two decisions,<br \/>\nobserved that the aforesaid decisions are conflicting decisions and<br \/>\nreferred the matter for hearing by a Larger Bench.\n<\/p>\n<p>5.\tNow<br \/>\nit is brought to our notice another decision of a Division Bench of<br \/>\nthis Court in the case of <a href=\"\/doc\/1975914\/\">Dilipbhai<br \/>\nManeklal Vyas vs. Torrent Power AEC Co.,<\/a> reported in 2007<br \/>\n(2) GLH 474, wherein at para 31, the Division Bench observed that<br \/>\n&#8220;the appellant has not joined the Industrial Tribunal as one of<br \/>\nthe respondents in petition nor claim any relief as such against the<br \/>\nIndustrial Tribunal.  Moreover, even writ of certiorari has not been<br \/>\nprayed for and hence there is no question of issuance of such writ in<br \/>\nfavour of the petitioner\/appellant.&#8221;  The aforesaid<br \/>\nobservations were made while referring to the Division Bench decision<br \/>\nin the case of  Steel<br \/>\nAuthority of India (supra).\n<\/p>\n<p>6.\tSimilar<br \/>\nissue fell for consideration recently before another Division Bench<br \/>\nof this Court in <a href=\"\/doc\/109012497\/\">Gustadji<br \/>\nDhanjisha Buhariwala vs. Nevil B Buhariwala,<\/a> reported in<br \/>\n2011 (2) GLH 147.  In the said case, referring to the Supreme Court<br \/>\ndecision in <a href=\"\/doc\/1668065\/\">Shalini Shyam<br \/>\nShetty vs. Rajednra Shankar Patel,<\/a> reported in (2010) 8<br \/>\nSCC 329,  the Division Bench has observed at para 54 that &#8220;in a<br \/>\npetition for relief under Article 226 of the Constitution, the<br \/>\nCourt\/Tribunal whose order is impugned in the petition must be made a<br \/>\nparty to the petition so that the writ sought from the Court can go<br \/>\nagainst the Court\/Tribunal, but if the petition is for relief under<br \/>\nArticle 227 of the Constitution, it is well settled that the<br \/>\nCourt\/Tribunal whose order is impugned in a petition need not be a<br \/>\nparty in the writ petition, the reason being by entertained the<br \/>\npetition under Article 227 of the Constitution the High Court<br \/>\nexercises its power of superintendence, which is analogous to the<br \/>\nrevisional jurisdiction.&#8221;\n<\/p>\n<p>7.\tThough<br \/>\nthe learned Single Judge observed that there are two conflicting<br \/>\ndecisions in the case  <a href=\"\/doc\/19838\/\">Steel<br \/>\nAuthority of India vs. GM Panchayat,<\/a> reported in 2004 (1)<br \/>\nGLR 729 and  in the case of <a href=\"\/doc\/762982\/\">Gujarat<br \/>\nState Road Transport Corporation vs. Pravin Joshi,<\/a><br \/>\nreported in 2004 (4) GLR 3379, if all the judgments are read, it may<br \/>\nclarify that one or other judgments may hold good at appropriate<br \/>\ncase, which depends upon the nature of the petition i.e. whether the<br \/>\npetition under Article 226 or article 227 of the Constitution or the<br \/>\npetition under Article 226 read with Article 227 of the Constitution.<br \/>\nHowever, for proper appreciation, we are of the view that the matter<br \/>\nbe heard by a Larger Bench preferably on 5th July, 2011 at<br \/>\n2.30 PM.\n<\/p>\n<p>\tThe<br \/>\nmatter be placed before the Chief Justice in its administrative side<br \/>\nfor appropriate orders.\n<\/p>\n<p>\t\t\t\t\t\t[S.\n<\/p>\n<p>J.
