No.<br \/>\n34\/2010 registered with Manavadar Police Station, Junagadh for the<br \/>\nalleged offences under sec. 465, 467,  471, 478,  120B  of IPC.\n<\/p>\n<p>2.\tLearned Sr. Cousel<br \/>\nMr. SV Raju  referred to the details with regard to different CRs of<br \/>\nthe complainant filed and submitted that there are two CRs alleging<br \/>\nsimilar or the same offences and therefore it would not be<br \/>\nmaintainable at all.  In support of his submission, he has referred<br \/>\nto and relied upon the judgment of the Hon&#8217;ble Apex Court in the case<br \/>\nof <a href=\"\/doc\/1974324\/\">T.T. Antony v. State of Kerala and ors.<\/a>, reported in (2001)<br \/>\n6 SCC 181.\n<\/p>\n<p>3.\tLearned Sr. Counsel<br \/>\nMr. Raju referred to the FIR as well as other papers and submitted<br \/>\nthat the applicant is working as an agent or commission agent and in<br \/>\nfact in the other FIR filed alleging the same offences, anticipatory<br \/>\nbail has been granted. He has produced the orders passed in Criminal<br \/>\nMisc. Application No. 462\/2008 by the Sessions Court and submitted<br \/>\nthat in fact the application for quashing the FIR has also been filed<br \/>\nand stay has been granted by this Court as per the order passed in<br \/>\nCriminal Misc Application no. 5357 to 5360 of 2009 vide order dated<br \/>\n15.3.2010 at Annexure-F (p. 102).\n<\/p>\n<p>4.\tLearned Sr. Counsel<br \/>\nMr. Raju has submitted that in fact no offence under sec. 465, 471<br \/>\nwould be attracted as the applicant cannot be said to have created<br \/>\nany forged document. In support of his submission he has referred to<br \/>\nand relied upon the judgment of the Hon&#8217;ble Apex Court reported in<br \/>\n(2009) 8 SCC 751 in the case of Mohammed Ibrahim and ors. v. State<br \/>\nof Bihar and anr. (para 13 &amp; 15). He, therefore submitted<br \/>\nthat the present application may be allowed when in the other FIR<br \/>\nanticipatory bail has been granted.  Learned Sr. Counsel Mr. Raju<br \/>\nalso submitted that in fact an application for cancellation of bail<br \/>\nwas also made which has been rejected by this court and therefore the<br \/>\npresent application may be granted.\n<\/p>\n<p>5.\tLearned APP Ms. Nair<br \/>\nreferred to the papers and submitted referring to the statement of<br \/>\ntwo witnesses Anil Thakkar and Chatur Shingala  that one trader,<br \/>\nco-accused, Bipinbhai has created a forged document and the name of<br \/>\nthe firm is not in existence as stated and on the basis of the forged<br \/>\nbills GST and CST nos the goods have been sold.  Learned APP Ms. Nair<br \/>\nsubmitted that the bills and the documents are not recovered.<br \/>\nTherefore, as the case is also for offence under sec. 120B and the<br \/>\nmatter is being investigated, the present application may not be<br \/>\nentertained.\n<\/p>\n<p>6.\tLearned advocate Mr.<br \/>\nZubin Bharda appearing for the complainant submitted that as the<br \/>\ninvestigation was at the initial stage, no document or papers were<br \/>\navailable and therefore interim relief was granted in other petition<br \/>\nfor anticipatory bail as well as in the petition filed for quashing.<br \/>\nHowever, he submitted that now there are some documents available<br \/>\nwhich suggest prima facie involvement of the applicant accused and<br \/>\ntherefore the present application may not be entertained.\n<\/p>\n<p>7.\tIn view of rival<br \/>\nsubmissions, it is required to be considered whether the present<br \/>\napplication can be entertained or not.\n<\/p>\n<p>8.\tIt is well accepted<br \/>\nthat this court is not required to appreciate and scrutinized the<br \/>\nevidence in detail at this stage. However, for considering the prima<br \/>\nfacie case for the purpose of deciding the present application, the<br \/>\nrelevant aspects like the nature of offence, the role attributed,<br \/>\nprima facie material and also the submission as discussed above with<br \/>\nregard to  grant of anticipatory bail as well as other aspects have<br \/>\nbeen considered in light of the guideline for exercise of discretion<br \/>\nunder sec. 438 of IPC. Therefore, the present application deserves to<br \/>\nbe allowed.\n<\/p>\n<p>9.\tThe application is<br \/>\naccordingly allowed. The applicant-accused is ordered to be released<br \/>\non bail in the event of his arrest in connection with C.R. No.<br \/>\n34\/2010 registered with Manavadar Police Station, Junagadh, in<br \/>\nrespect of the offence alleged against him on his executing a<br \/>\npersonal bond of Rs. 5,000\/- (Rupees Five Thousand only) each with<br \/>\none solvent surety for the like amount  and on further conditions<br \/>\nthat he shall :\n<\/p>\n<p>(a)\tremain present<br \/>\nbefore the trial court regularly as and when directed on the dates<br \/>\nfixed;\n<\/p>\n<p>(b)\tremain present at<br \/>\nthe concerned Police Station on 27.9.2010 between 11.00 am and 2.00<br \/>\npm.\n<\/p>\n<p>(c )\tmake himself<br \/>\navailable for interrogation by the police officer whenever and<br \/>\nwherever required.\n<\/p>\n<p>(d)\tnot directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade him from<br \/>\ndisclosing such facts to the court or to any police officer;\n<\/p>\n<p>(e)\tnot to obstruct or<br \/>\nhamper the police investigation and not to play mischief with the<br \/>\nevidence collected or  yet to be collected by the police;\n<\/p>\n<p>(f)\tat the time of<br \/>\nexecuting the bond, furnish his address to the I.O. and the courts<br \/>\nconcerned, and shall not change his residence till the final disposal<br \/>\nof the case or till further orders;\n<\/p>\n<p>(g)\tnot to leave India<br \/>\nwithout the permission of the court and if having a passport, shall<br \/>\ndeposit the same before the trial court within a week;\n<\/p>\n<p>10.\tIt would be open to<br \/>\nthe I.O. to file an application for remand if he considers it proper<br \/>\nand just and the learned Magistrate would decide it on merits.\n<\/p>\n<p>11.\tThis order will hold<br \/>\ngood if the applicant is arrested at any time within 90 days from<br \/>\ntoday.  The order for release on bail will remain operative only for<br \/>\na period of 10 days from the date of his arrest during which it will<br \/>\nbe open to the applicant to make a fresh application for being<br \/>\nenlarged on bail in usual course which, when it comes before the<br \/>\ncompetent court, will be disposed of in accordance with law having<br \/>\nregard to all the attending circumstances and the materials available<br \/>\nat the relevant time uninfluenced by the act that anticipatory bail<br \/>\nwas granted.\n<\/p>\n<p>\tRule is made absolute.\n<\/p>\n<p> D.S. permitted.\n<\/p>\n<p>(Rajesh H.
