Learned APP, Mr.L.R.Pujari and learned advocate, Mr.Shailesh<br \/>\n\tSharma,  waive service of rule on behalf of the respondent Nos.1 and<br \/>\n\t2 respectively.\n<\/p>\n<p>2.<br \/>\n\tThe applicant-accused was convicted for the offences punishable<br \/>\n\tunder Section 138 of the Negotiable Instruments Act by the judgment<br \/>\n\tand order dated 30-6-2004 passed in Criminal Case No.1517 of 1999<br \/>\n\tby the learned Judicial Magistrate First Class, Morbi,  and the<br \/>\n\tapplicant-accused was sentenced to suffer simple imprisonment for<br \/>\n\tone year and to pay fine of Rs.5,000\/-, in default, to suffer SI for<br \/>\n\ttwo months.\n<\/p>\n<p>3.<br \/>\n\tBeing aggrieved and dissatisfied with the said judgment and order,<br \/>\n\tthe applicant accused preferred Criminal Appeal No.13 of 2004<br \/>\n\tbefore the learned Additional  Sessions Judge, Morbi.  However, the<br \/>\n\tlearned Additional Sessions Judge, Morbi has  dismissed  the said<br \/>\n\tappeal vide judgment and order dated 30-3-2011.\n<\/p>\n<p>4.<br \/>\n\t  Both the aforesaid  judgments and orders are under challenge by<br \/>\n\tthe applicant in the present Criminal Revision Application.\n<\/p>\n<p>5.<br \/>\n\t  It has been submitted by  learned advocate Mr.Thakur for the<br \/>\n\tapplicant-accused that the matter is settled between the parties,<br \/>\n\tand as per the settlement, the complainant has received the cheque<br \/>\n\tamount in question.  Learned advocate for the respondent has also<br \/>\n\tsubmitted that  the matter is settled between the parties. He has<br \/>\n\tplaced the copy of settlement on the record of the case.  He has<br \/>\n\talso stated that now he has no grievance against the<br \/>\n\tapplicant-accused.\n<\/p>\n<p>6.<br \/>\n\t The Apex Court in the case of <a href=\"\/doc\/1981864\/\">Vinay Devanna Nayak v. Ryot Seva<br \/>\n\tSahakari Bank Ltd.<\/a>  reported in AIR 2008 SC 716 has<br \/>\n\tobserved as under in paras 17<br \/>\n\tand 18 of the judgment:\n<\/p>\n<p>&#8220;17.\n<\/p>\n<p>As observed by this Court in <a href=\"\/doc\/979235\/\">Electronic Trade &amp; Technology<br \/>\nDevelopment Corporation Ltd.\tv. Indian Technologists and Engineers,<\/a><br \/>\n1996) 2\tSCC 739, the object of bringing Section 138 in the statute<br \/>\nbook is to inculcate faith in the\tefficacy of banking operation and<br \/>\ncredibility in transacting business on negotiable instruments.\tThe<br \/>\nprovision is intended to prevent dishonesty on the party of the<br \/>\ndrawer of negotiable instruments in issuing cheques without<br \/>\nsufficient funds or with a view to inducing the\tpayee or holder in<br \/>\ndue course to act upon it. It\tthus seeks to promote the efficacy of<br \/>\nbanking\toperations and ensures credibility in\ttransacting business<br \/>\nthrough cheques. In such matters, therefore, normally compounding<br \/>\nof\toffences should not be denied. Presumably,\tParliament also<br \/>\nrealized this aspect and\tinserted Section 147 by the<br \/>\nNegotiable\tInstruments(Amendment and Miscellaneous\tProvisions )Act,<br \/>\n2002 (Act 55 of 2002.&#8221;\n<\/p>\n<p>&#8220;18.\n<\/p>\n<p>Taking into consideration even the said provision(Section 147) and<br \/>\nthe primary object underlying Section 138, in our judgment, there\tis<br \/>\nno reason to refuse compromise between the\tparties. We therefore<br \/>\ndispose of the appeal on\tthe basis of the settlement arrived at<br \/>\nbetween\tthe appellant and the respondent.&#8221;\n<\/p>\n<p>\t7.<br \/>\n\t Applying the ratio of the aforesaid decision of the Apex Court to<br \/>\n\tthe facts of the present case, I am of the opinion that this<br \/>\n\tRevision Application is required to be allowed and the parties be<br \/>\n\tpermitted to compound the offence.\n<\/p>\n<p>\t8.<br \/>\n\t In the result, the Revision Application is allowed. The judgment<br \/>\n\tand order of conviction and sentence dated 30-6-2004 passed in<br \/>\n\tCriminal Case No.1517 of 1999  by the learned  Judicial Magistrate<br \/>\n\tFirst Class, Morbi  as also the<br \/>\n\tjudgment and order dated 30-3-2011 passed in Criminal Appeal No.13<br \/>\n\tof 2004 by the learned Additional  Sessions Judge, Morbi  dismissing<br \/>\n\tthe same are hereby quashed and set aside and the<br \/>\n\tapplicant-accused is set at liberty forthwith if he is not required<br \/>\n\tin any other case. The parties are permitted to compound the<br \/>\n\toffence. The amount of fine  deposited by the  applicant-accused<br \/>\n\tbefore the trial court or the appellate court in pursuance of the<br \/>\n\torder passed by them, the applicant is at liberty to withdraw the<br \/>\n\tsaid amount by submitting application before the appropriate Court.<br \/>\n\tRule is made absolute.
