No.2299 of 2011\n                  KUNAL KUMAR SAHNI, SON OF GOPAL PRASAD SAHNI\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>02   04.03.2011             Both the above stated criminal miscellaneous cases arise<\/p>\n<p>                     out of Kadamkuan P.S. Case No. 282 of 2010 registered under<\/p>\n<p>                     Sections 302, 120(B) of the Indian Penal Code, 27 of the Arms Act<\/p>\n<p>                     and accordingly, both the above stated criminal miscellaneous cases<\/p>\n<p>                     are being disposed of by this common order.\n<\/p>\n<p>                                    Petitioners are not named in the First Information Report<\/p>\n<p>                     and during course of investigation their names surfaced in this case.<\/p>\n<p>                                    Contention of learned counsel for the petitioners is that<\/p>\n<p>                     none of the person has claimed to have seen the petitioners committing<\/p>\n<p>                     the alleged crime and except the confessional statement of co-accused<\/p>\n<p>                     Rajesh Sahini @ Bhutali there is nothing against the petitioners.<\/p>\n<p>                                    Learned counsel for the petitioners further submits that so<\/p>\n<p>                     far as the paragraphs, referred by learned Additional Sessions Judge in<\/p>\n<p>                     his impugned order are concerned, the same are nothing but only the<\/p>\n<p>                     stereo type statements of the prosecution witnesses without naming the<\/p>\n<p>                     petitioners.\n<\/p>\n<p>                                    Considering the aforesaid facts and circumstances as well<\/p>\n<p>                     as submissions of the parties, let the petitioners be released on bail on<\/p>\n<p>                     furnishing bail bond of Rs. 10,000\/- (Ten Thousand) each with two<\/p>\n<p>                     sureties of the like amount each to the satisfaction of Chief Judicial<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          Magistrate, Patna in connection with above stated Kadamkuan P.S.<\/p>\n<p>          Case No. 282 of 2010.\n<\/p>\n<\/p>\n<pre>Shahzad              ( Hemant Kumar Srivastava, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rakesh Chaudhary vs The State Of Bihar on 4 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
