Justice M.C.HARI RANI\n\n Dated :11\/12\/2008\n\n O R D E R\n                       M.C.HARI RANI, JJ.\n          -----------------------------------------------------\n                 CRL.M.C.No.2888 OF 2005\n       -----------------------------------------------------\n           DATED THIS THE 11th DAY OF DECEMBER, 2008\n\n                             O R D E R\n<\/pre>\n<p>     The petitioner herein is the accused in C.C.No.72\/04 before<\/p>\n<p>the  Court    of  J.F.C.M.,   Ambalappuzha.     The    petitioner is<\/p>\n<p>challenging the validity of Annexure C order dated 30.7.2005 in<\/p>\n<p>C.M.P.No.2047\/05 passed by the J.F.C.M., Ambalappuzha. The<\/p>\n<p>prayer in this petition is to quash Annexure C order and the<\/p>\n<p>application for amendment Annexure B by exercising the<\/p>\n<p>extraordinary power of this Court under Section 482 of Cr.P.C.<\/p>\n<p>     2.    Heard the learned counsel appearing for the petitioner<\/p>\n<p>and the 2nd respondent.      Heard the learned Public Prosecutor<\/p>\n<p>also.\n<\/p>\n<p>     3.    It is submitted by the learned counsel appearing for<\/p>\n<p>the petitioner that Annexure A complaint was filed originally by<\/p>\n<p>the second respondent herein under Section 420 of Indian Penal<\/p>\n<p>Code. The learned Magistrate took cognizance of the case as<\/p>\n<p>C.C.No.72\/2004. Annexure A complaint was filed on 23.9.2003.<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO.2888\/05                2<\/span><\/p>\n<p>Subsequently, the second respondent filed Annexure B petition<\/p>\n<p>before the concerned court for incorporating Section 138 of the<\/p>\n<p>Negotiable Instruments Act also, by filing a petition on 2.7.2005<\/p>\n<p>along with an affidavit. In pursuance of that petition, Annexure C<\/p>\n<p>order has been passed by the learned Magistrate, which is<\/p>\n<p>without jurisdiction and cannot be allowed. Therefore, that order<\/p>\n<p>is liable to be quashed, it is submitted.\n<\/p>\n<p>      4.    Learned counsel for the second respondent submitted<\/p>\n<p>that sufficient ingredients are there in the original complaint to<\/p>\n<p>attract the offence under Section 138 of N.I.Act and for<\/p>\n<p>incorporating that Section also along with the impugned<\/p>\n<p>complaint, Annexure B petition was filed and there is no illegality<\/p>\n<p>in Annexure C order.\n<\/p>\n<p>      5.    I have perused the records and also the allegations in<\/p>\n<p>this petition.   The prayer made by the second respondent in<\/p>\n<p>Annexure B petition is to amend the original complaint filed on<\/p>\n<p>23.9.2003 for the offence under Section 420 of Indian Penal Code<\/p>\n<p>and to include Section 138 of the Negotiable Instruments Act.<\/p>\n<p>The order of the learned Magistrate, Annexure C reads as follows:<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO.2888\/05               3<\/span><\/p>\n<blockquote><p>            &#8220;This is a petition filed by the complainant to<\/p>\n<p>      amend the complaint by incorporating Section 138 of<\/p>\n<p>      N.I.Act.\n<\/p><\/blockquote>\n<blockquote><p>            The complaint is filed u\/s.420 IPC.      On going<\/p>\n<p>      through the complaint, it can be seen that the<\/p>\n<p>      ingredients of Section 138 of Negotiable Instruments Act<\/p>\n<p>      appear to have attracted. No prejudice will be caused to<\/p>\n<p>      the accused by incorporating S.138 of Negotiable<\/p>\n<p>      Instruments Act. Hence petition is allowed.&#8221;<\/p>\n<\/blockquote>\n<p>Thus, it is evident from the impugned order that the learned<\/p>\n<p>Magistrate has allowed the petition for amendment and Section<\/p>\n<p>138 of the Negotiable Instruments Act was incorporated for the<\/p>\n<p>reason that sufficient ingredients are there to attract Section 138<\/p>\n<p>of N.I.Act and no prejudice will be caused to the accused. There<\/p>\n<p>is no provision in the Code of Criminal Procedure to allow an<\/p>\n<p>amendment of the original complaint thereby incorporating<\/p>\n<p>Section 138 of N.I.Act also in a complaint originally filed under<\/p>\n<p>Section 420 of IPC only. If sufficient ingredients are there, the<\/p>\n<p>Magistrate can frame charge under Section 138 of N.I.Act also.<\/p>\n<p>The proceedings in this case has not reached that stage. Before<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO.2888\/05                 4<\/span><\/p>\n<p>reaching that stage, the petitioner herein has approached the<\/p>\n<p>trial court to invoke the provision of law to amend the complaint<\/p>\n<p>which is not there in the Cr.P.C. Therefore, the procedure<\/p>\n<p>adopted by the learned Magistrate is not correct and the same<\/p>\n<p>was passed inadvertently. Therefore, I find that this is a fit case<\/p>\n<p>where Annexure C order is liable to be quashed by invoking the<\/p>\n<p>inherent jurisdiction of this Court under Section 482 of Cr.P.C.<\/p>\n<p>Therefore, the prayer in this petition to quash Annexure C order<\/p>\n<p>passed    by    the   learned  Judicial   First Class Magistrate,<\/p>\n<p>Ambalappuzha, is allowed.\n<\/p>\n<p>      In the result, the Crl.M.C. is allowed.\n<\/p>\n<\/p>\n<p>                                   M.C.HARI RANI, JUDGE.\n<\/p>\n<p>dsn<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.
