\tThis is an application
\n\tunder Section 439 of Criminal Procedure Code praying for regular
\n\tbail in connection with the offence registered with Mehmedabad
\n\tPolice Station, District Kheda vide C.R.No.I-86 of 2011 for the
\n\toffences punishable under 363, 366 and 376 of the Indian Penal Code
\n\tand under Section 3(1) sub-clause (xii) of  the Scheduled Case and
\n\tScheduled Tribe (Prevention of Atrocity) Act.\n<\/p>\n
\tCase of the prosecution
\n\tprima facie appears to be that the accused-applicant abducted
\n\tprosecutrix who happens to be daughter of first informant on
\n\t10.04.2011. Prosecution has alleged that applicant-accused after
\n\tenticing prosecutrix eloped from the village and stayed outside upto
\n\t16.04.2011. It is the case of the prosecution that during the
\n\tinterregnum period the accused-applicant had forcible physical
\n\trelations with the prosecutrix and thereby committed offence under
\n\tsection 376 of the IPC.\n<\/p>\n
\tI have heard Mr.Devang J.\n<\/p>\n
\tJoshi, learned advocate for the applicant and Ms.Krina Calla,
\n\tlearned APP for the State.\n<\/p>\n
\tPerused papers of the
\n\tcharge sheet. Taking into consideration entire back ground in which
\n\tincident has occurred, I am persuaded to exercise my discretion in
\n\tfavour of the accused-applicant taking into consideration following
\n\taspects :-\n<\/p>\n
(i)
\n\tIt is clear from the history given by the prosecutrix before the
\n\tDoctor at the time of medical examination on 16.04.2011 that she was
\n\tvery much in love with the applicant accused. Both of them had
\n\tfeelings and intimacy for each other. She has further stated that on
\n\ther own free will, she accompanied accused. She has also stated that
\n\twith her permission and consent they had physical relationship. The
\n\tmedical certificate dated 16.4.2011 and statement  of the
\n\tprosecutrix dated 16.4.2011 speaks for itself.\n<\/p>\n
(ii)
\n\tOn the date of incident, she was 16 years and 2 months old and the
\n\tapplicant accused was about 21 years of age.\n<\/p>\n
(iii)
\n\tIt is also very clear from the papers and charge sheet and the
\n\tstatement of the prosecutrix that after eloping on 10.04.2011, they
\n\tmoved around at different places till 16.04.2011.\n<\/p>\n
(iv)
\n\tInvestigation is over and charge sheet has been filed.\n<\/p>\n
\tThis Court while deciding
\n\tCriminal Misc. Application No.7697 of 2011 has observed as under :-\n<\/p>\n
“6.\n<\/p>\n
\tOffence of this nature are required to be considered from the view
\n\tpoint of following facts and circumstances:-\n<\/p>\n
(1)<\/span><\/p>\n
\tWas the accused in a position to influence the girl and take
\n\tadvantage of her inferior position such as that the girl being in
\n\tservice under the accused or the girl being under some obligation of
\n\tthe accused ?\n<\/p>\n
(2)<\/span><\/p>\n
\tIs the relationship between the accused and the girl that of an
\n\temployer and an employee or that of a teacher and a student or that
\n\tof a person in authority and a subordinate or that of a police
\n\tofficer and a citizen who is required to be protected by the former?\n<\/p>\n
(3)<\/span><\/p>\n
\tThere may not be any relation whatsoever between the accused and the
\n\tgirl and it may be that the accused might be taking the advantage of
\n\tthe situation that existed at the time of the incident.\n<\/p>\n
(4)<\/span><\/p>\n
\tThe respective ages of the accused and the girl. Is the accused
\n\tfairly advanced in age and the girl is comparatively of younger age
\n\t?\n<\/p>\n
(5)<\/span><\/p>\n
\tWas the girl forcibly raped? Were there any marks of injury on the
\n\tgirl or the person of the accused?\n<\/p>\n
(6)<\/span><\/p>\n
\tThe accused and the girl being in the same age groups say teenagers
\n\tor in their early twenties might have come nearer on account of
\n\tnatural physical attraction towards each other. In such a situation
\n\thas the boy (I.e. accused) become prey to temptation of indulging in
\n\tunlawful sexual activity? And is there no element of force in such
\n\tunlawful sexual activity?\n<\/p>\n

\n\tIf the case falls in the last category i.e. no.6 then it does not
\n\trequire to be treated on par with the cases of sexual offences
\n\tnarrated in the above mentioned 1 to 5 categories. Present case
\n\tfalls in the last category.”\n<\/p>\n
\tIn this view of the
\n\tmatter, I am persuaded to exercise my discretion in favour of the
\n\taccused applicant. Under the circumstances, accused-applicant is
\n\tordered to be enlarged on regular bail in connection with offence
\n\tregistered with Mehmedabad Police Station, District Kheda vide
\n\tC.R.No.I-86 of 2011 on executing a bond in the sum of Rs.15,000\/-
\n\t(Rupees fifteen thousand only) with one surety of the like amount to
\n\tthe satisfaction of the lower Court and subject to the conditions
\n\tthat he shall :\n<\/p>\n
(a)
\n\tnot take undue advantage of his liberty or misuse his liberty;\n<\/p>\n
(b)
\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n
(c)
\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n
(d)
\n\tnot leave the State of Gujarat without prior permission of the
\n\tSessions Judge concerned;\n<\/p>\n
(e)
\n\tmark presence at the concerned police station once in a month
\n\tbetween 10.00 a.m. and 2.00 p.m. <\/p>\n
(f)
\n\tfurnish the present address of his residence to the I.O. and also to
\n\tthe Court at the time of execution of the bond and shall not change
\n\tthe residence without prior permission of this Court;\n<\/p>\n
(g)
\n\tshall not enter into the Dist.Kheda and shall not try to meet
\n\tprosecutrix at any point of time or try to approach any of the
\n\tfamily members of the prosecutrix.\n<\/p>\n
(h)
\n\tThe Authorities will release the applicant only if not required in
\n\tconnection with any other offence for the time being.\n<\/p>\n
\tIf breach of any of the
\n\tabove conditions is committed, the Sessions Judge concerned will be
\n\tfree to issue warrant or take appropriate action in the matter.\n<\/p>\n
\tBail bond to be executed
\n\tbefore the lower court having jurisdiction to try the case.\n<\/p>\n
It
\n\tgoes without saying that any observations touching the merits of the
\n\tcase are purely for the purpose of deciding the question of grant of
\n\tbail and shall not be construed as an expression of the final
\n\topinion in the main matter.\n<\/p>\n
Rule
\n\tis made absolute to the aforesaid extent. Direct service is
\n\tpermitted.\n<\/p>\n
