SHARMA, J (ORAL)<\/p>\n<p>          This regular second appeal is directed against the judgments<\/p>\n<p>and decrees dated 7.4.2005 and 30.10.2007 passed by the learned Courts<\/p>\n<p>below vide which the suit filed by the plaintiff\/appellant seeking<\/p>\n<p>mandatory injunction for enforcement of agreement entered into between<\/p>\n<p>the parties has been ordered to be dismissed.<\/p>\n<p>          The plaintiff claimed that in pursuance of the agreement<\/p>\n<p>entered into between the parties, he was entitled to use of passage from<\/p>\n<p>the land of the defendant\/respondents.\n<\/p>\n<p>          The suit was contested.\n<\/p>\n<p>          The plaintiff produced on record carbon copy of the agreement<\/p>\n<p>as Ex. P-1 in support of his contention that there was an agreement<\/p>\n<p>between the parties, which was disputed by the defendant\/respondents.<br \/>\n R.S.A. No. 680 of 2008<br \/>\n<span class=\"hidden_text\">                                                                        -2-<\/span><\/p>\n<p>          The learned Courts below have recorded concurrent finding of<\/p>\n<p>fact that the plaintiff has failed to prove that there was any agreement<\/p>\n<p>entered into between the parties or acted upon.<\/p>\n<p>          The learned Courts rejected document Ex. P-1 by observing<\/p>\n<p>that this was not a primary evidence and the same could not be said to<\/p>\n<p>have been proved without the production of original.<\/p>\n<p>          The learned counsel appearing on behalf of the appellant<\/p>\n<p>contends that the finding recorded by the learned Courts below is<\/p>\n<p>perverse on the face of record and is outcome of misreading of evidence,<\/p>\n<p>inasmuch as Ex. P-1 was duly proved on record by examining the<\/p>\n<p>executant of the agreement and the attesting witness.<\/p>\n<p>          The signatures of the defendants were also proved on the<\/p>\n<p>agreement.    However, the learned Courts below have rejected the<\/p>\n<p>document being not primary document to be taken in evidence.<\/p>\n<p>          The plea of the learned counsel for the appellant cannot be<\/p>\n<p>accepted. Once it is admitted that the document Ex. P-1 was merely<\/p>\n<p>carbon copy, it could not be said to be primary document in view of<\/p>\n<p>explanation 2 to Section 62 of the evidence Act, which defines the<\/p>\n<p>primary evidence. The explanation 2 to Section 62 reads as under: &#8211;<\/p>\n<blockquote><p>               &#8220;Explanation 2. &#8211; Where a number of documents are all<\/p>\n<p>               made by one uniform process, as in the case of printing,<\/p>\n<p>               lithography, or photography, each is primary evidence of<\/p>\n<p>               the cotents of the rest; but, where they are all copies of a<\/p>\n<p>               common original, they are not primary evidence of the<\/p>\n<p>               contents of the original.&#8221;<\/p><\/blockquote>\n<p>          It is not the case of the appellant that the document was proved<br \/>\n R.S.A. No. 680 of 2008<br \/>\n<span class=\"hidden_text\">                                                                     -3-<\/span><\/p>\n<p>by way of secondary evidence.\n<\/p>\n<p>          The learned Courts, therefore, rightly concluded that the<\/p>\n<p>plaintiff has failed to prove on record the agreement, nor any evidence<\/p>\n<p>was brought to prove that this was ever acted upon by the parties.<\/p>\n<p>          The cocurrent finding of fact cannot be said to be perverse as<\/p>\n<p>contended by the learned counsel for the appellant.<\/p>\n<p>          The appeal does not raise any substantial question of law for<\/p>\n<p>consideration by this Court.\n<\/p>\n<p>          No merit.\n<\/p>\n<p>          Dismissed.\n<\/p>\n<p>                                                  (Vinod K.
