Patel, learned advocate waives the service of notice<br \/>\n\tof rule on behalf of the respondent No.1 and Mr.Nitin  M. Amin,<br \/>\n\tlearned advocate waives the service of notice of rule on behalf of<br \/>\n\tthe respondent Nos.3\/1 to 3\/4.\n<\/p>\n<p>Present<br \/>\n\tCivil Revision<br \/>\n\tApplication  has been preferred by the petitioners   &#8211;<br \/>\n\toriginal applicants\/plaintiffs challenging the impugned order<br \/>\n\tdtd.7\/10\/2008  passed by the learned Principal Senior Civil Judge,<br \/>\n\tAhmedabad in Civil Misc.Application No.96 of 2008, by which  the<br \/>\n\tlearned trial court has dismissed the said application to restore<br \/>\n\tRegular<br \/>\n\tCivil Suit  No. 72 of 2009, to file.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Y.F. Mehta, learned<br \/>\n\tadvocate appearing on behalf of the petitioner  and<br \/>\n\tMr.Tattvam K. Patel, learned advocate appearing on behalf of the<br \/>\n\trespondent No.1 and Mr.Nitin  M. Amin, learned advocate appearing on<br \/>\n\tbehalf of the respondent Nos.3\/1 to 3\/4  &#8211; contesting respondents<br \/>\n\tand in the facts and circumstances of the case, when the Court was<br \/>\n\trequired was inclined to allow the Misc.Civil Application for<br \/>\n\trestoration of the suit, Mr.Tattvam K. Patel, learned advocate and<br \/>\n\tMr.Nitin  M. Amin, learned advocate appearing on behalf of the<br \/>\n\trespective respondents have stated at the bar that if reasonable<br \/>\n\tcost is imposed upon the petitioner<br \/>\n\t to be paid to the respondent Nos.3\/1 and Respondent No.1, they<br \/>\n\t do not invite have any further reasoned order while allowing the<br \/>\n\tpresent Civil Revision<br \/>\n\tApplication while quashing and setting aside the impugned<br \/>\n\torder and restoring the main Civil Suit to file.\n<\/p>\n<p>Mr.Y.F.\n<\/p>\n<p>\tMehta, learned<br \/>\n\tadvocate appearing on behalf of the petitioner  has submitted that<br \/>\n\tthe petitioner  is ready and willing to pay reasonable<br \/>\n\tcost to the concerned respondents as may be directed by this Hon&#8217;ble<br \/>\n\tCourt, while allowing the present Civil<br \/>\n\tRevision Application and restoring the original Civil Suit to<br \/>\n\tfile.\n<\/p>\n<p>Considering<br \/>\n\tthe above statements made by the learned advocates appearing on<br \/>\n\tbehalf of the respective parties, this Court does not assign any<br \/>\n\tfurther reasoned order and the impugned order dtd.7\/10\/2008  passed<br \/>\n\tby the learned Principal Senior Civil Judge, Ahmedabad in Civil<br \/>\n\tMisc. Application No.96 of 2008 is hereby quashed and set aside and<br \/>\n\tRegular<br \/>\n\tCivil Suit  No. 72 of 2009 is restored to file on<br \/>\n\tcondition that the petitioner<br \/>\n\t shall pay a sum of Rs.5000=00 (Rupees Five Thousand<br \/>\n\tonly) to each of the respondent Nos.1  and respondent.3\/1 by Demand<br \/>\n\tDraft or Pay Order to be paid within a period of ten days from<br \/>\n\ttoday. On such  payment and declaring the same before the learned<br \/>\n\ttrial court, the learned trial court is hereby directed to restore<br \/>\n\tthe Regular<br \/>\n\tCivil Suit  No. 72 of 2009<br \/>\n\t to its file and proceed further with the  same in<br \/>\n\taccordance with law and on merits.
