After the\nacquisition, the  municipality parcelled out the excess land\nand sold  it for  a housing colony. The High Court dismissed\nthe appellants' writ petition, in limine.\n     On appeal\tto this\t Court it  was\tcontended  that\t the\nacquisition was\t not for  a public  purpose and\t that it was\nmala fide.\n     Dismissing the appeal,\n^\n     HELD: (1)(a)  Providing a\tvillage market is an obvious\npublic purpose.\n     [876C-D]\n     (b) A  mondha is  a country  fair\tor  village  market.\nMarket is  defined in  s. 2(20)\t of the\t Hyderabad  District\nMunicipalities Act  in wide  terms and s. 72 of the said Act\nenumerates the\tpurposes for which property may be vested in\na  municipality.   This\t includes  markets.  It\t inexoorably\nfollows from  a joint  reading of Ss. 2(20) and 72(a) of the\nDistrict Municipalities\t Act that the purpose of providing a\nmarket for  the townsfolk  falls within\t the powers  of\t the\nmunicipality. [876G-H]\n     (2)(a) Striking  down any Act for mala fide exercise of\npower is  a judicial  resered power  exercised lethally, but\nrarely. The  charge of\tmala fides against public bodies and\nauthorities is\tmore easily  made than\tmade out.  It is the\nlast refuge of a losing litigant. [876D]\n     (b) What has to be established is mala fide exercise of\npower by  the State  Government although  the beneficiary is\nthe municipality.  There is  no evidence  of malus animus in\nGovernment. [877B]\n     (c) Apart\tfrom the  fact that  a housing\tcolony is  a\npublic necessity, once the original acquisition is valid and\ntitle has  vested in the municipality how it uses the excess\nland is\t no concern  of the original owner and cannot be the\nbasis  for   invalidating  the\t acquisition.  There  is  no\nprinciple of  law by  which a  valid compulsory\t acquisition\nstands voided  because long  later the\trequiring  authority\ndiverts it  to a public purpose other than the one stated in\nthe declaration. Gopalakrishnan, for<br \/>\nrespondent no. 3<br \/>\n<span class=\"hidden_text\">876<\/span><br \/>\n     The Jugement of the Court was delivered by<br \/>\n     KRISHNA IYER,  J. Brevity\twill do\t no inequity in this<br \/>\nappeal where  three points  were urged but only one survives<br \/>\nfor serious  scanning. The subject matter is the validity of<br \/>\nland  acquisition   proceedings\t  whereby   a\tMunicipality<br \/>\ncompulsorily purchased\tthe appellant&#8217;s\t land for the stated<br \/>\npublic purpose\tof running a country fair or market (mondha)<br \/>\nunder the  Hyderabad Land  Acquisition Act  (for short,\t the<br \/>\nAct) which  is closely\tsimilar to the Land Acquisition Act,<br \/>\n1923 (Central  Act). The first charge is that the High Court<br \/>\ndismissed the Writ Petition in limine. Seven years after the<br \/>\n1968 event, we cannot consider sending back the case even if<br \/>\nthere be  justice in the submission. We have therefore heard<br \/>\ncounsel Shri  Deshpande on  his substantive  grievances. The<br \/>\nsecond contention  is that  there is  no &#8216;public purpose&#8217; to<br \/>\nsupport the acquisition which is allegedly ultra a vires the<br \/>\nMunicipality&#8217;s powers.\tWe  disagree.  Providing  a  village<br \/>\nmarket\tis   an\t obvious  public  purpose  and\ta  municipal<br \/>\nfacility. The  last plea  which has been pressed strenuously<br \/>\nis that\t the acquisition  exercise is bad being mala fide-an<br \/>\nuphill task  to make  out against  a public  body. Was\tthis<br \/>\ncolourable exercise of power ?\n<\/p>\n<p>     Striking down  any act  for mala fide exercise of power<br \/>\nis a  judicial reserve power exercised lethally, but rarely.<br \/>\nThe  charge   of  mala-fides   against\tpublic\t bodies\t and<br \/>\nauthorities is\tmore easily  made than\tmade out.  It is the<br \/>\nlast refuge  of a  losing litigant. Even so, we will examine<br \/>\nthe merits  of the contention here from the point of view of<br \/>\nthe serious factors placed for our consideration.\n<\/p>\n<p>     Was  this\t acquisition  done   colore  officii  ?\t The<br \/>\ncircumstances  relied\ton  may\t  be  examined\t from\tthis<br \/>\nstandpoint. Section 5(3) of the Act provides for declaration<br \/>\nof the public purpose, like s. 6(3) of the Central Act. This<br \/>\ndeclaration was\t made in  1960 and covered at least 28 acres<br \/>\nof land\t belonging to  the appellant.  His counsel  contends<br \/>\nthat  there   in  no   public  purpose\t mentioned  in\t the<br \/>\nnotification because what is stated is &#8216;government purpose&#8217;.<br \/>\nThere is  no force  in this  terminological  deviation.\t The<br \/>\npurpose has  been set  down as\tfor a  &#8216;mondha&#8217; or  &#8216;country<br \/>\nfair&#8217; which  is\t obviously  a  public  purpose.\t So  counsel<br \/>\nshifted to another shade of the same argument and state that<br \/>\n&#8216;mondha&#8217; is not a word known to law and has not been defined<br \/>\nanywhere and so such a purpose cannot be taken cognizance of<br \/>\nby  the\t  law.\tWe  cannot  agree  to  the  linguistic\tgame<br \/>\nmasquerading as\t a legal  point. It is plain that a &#8216;mondha&#8217;<br \/>\nis a  country fair or village market. &#8216;Market&#8217; is defined in<br \/>\ns. 2(20)  of the  Hyderabad District  Municipalities Act  in<br \/>\nwide terms,  and s.  72\t of  the  said\tAct  enumerates\t the<br \/>\npurposes for which property may be vested in a municipality.<br \/>\nThis includes  &#8216;markets&#8217;. It inexorably follows from a joint<br \/>\nreading of ss. 2(20) and 72(a) that the purpose of providing<br \/>\na market  for the  townsfolk falls  within the\tpowers of  a<br \/>\nmunicipality.\n<\/p>\n<p>     Failing here, counsel finally stressed that in any case<br \/>\nno market  for a  small municipal  town requires 28 acres of<br \/>\nland, especially  because the  Master Plan  prepared for the<br \/>\nMunicipality had allotted<br \/>\n<span class=\"hidden_text\">877<\/span><br \/>\nonly 15\t acres for  this purpose. lt is not for the Court to<br \/>\ninvestigate into  the area  necessary for  running a market.<br \/>\nMoreover  there\t  is  no   mala\t fides\temerging  from\tthis<br \/>\ncircumstance. What  has\t to  be\t established  is  mala\tfide<br \/>\nexercise of  power by  the  State  Government-the  acquiring<br \/>\nauthority-although the\tbeneficiary of\tthe  acquisition  is<br \/>\neventually  the\t Municipality.\tThere  is  no  scintilla  of<br \/>\nevidence suggestive of malus animus in Government.\n<\/p>\n<p>     At this  state Shri  Deshpande complained that actually<br \/>\nthe Municipal  Committee  had  sold  away  the\texcess\tland<br \/>\nmarking them  out into\tseparate plots for a housing colony,<br \/>\napart from  the fact  that a  housing  colony  is  a  public<br \/>\nnecessity, once\t the original acquisition is valid and title<br \/>\nhas vested  in the Municipality, how it uses the excess land<br \/>\nis no  concern of the original owner and cannot be the basis<br \/>\nfor invalidating  the acquisition.
