Braj Kishore Jha, son of Sri Ram Chandra Jha\n                                             Versus\n                                    The State Of Bihar\n                                 ----------------------------------\n<\/pre>\n<p>2.   29.09.2011              Heard learned counsel for the petitioners and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioners seek bail in a case instituted for the<\/p>\n<p>                  offence under Section 304(B) of the Indian Penal Code.<\/p>\n<p>                               Considering that initially a U.D. case was instituted for<\/p>\n<p>                  the death of the daughter-in-law and a suicide note recovered as<\/p>\n<p>                  also that there is no specific overt act alleged against the<\/p>\n<p>                  petitioners, let the petitioners above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) each with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be fixed by<\/p>\n<p>                  the court concerned to the satisfaction of Additional Chief Judicial<\/p>\n<p>                  Magistrate, Patna City, Patna, in connection with Agam Kuan P.S.<\/p>\n<p>                  Case No. 165 of 2009, subject to the following conditions: (i) That<\/p>\n<p>                  one of the bailors will be a close relative of the petitioners, who will<\/p>\n<p>                  give an affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioners. The bailors will undertake to furnish information to<\/p>\n<p>                  the court about any change in the address of the petitioners.<\/p>\n<p>                  (ii) That the petitioners will give an undertaking that they will<\/p>\n<p>                  receive the police papers on the given date and be present<\/p>\n<p>                  on date fixed for charge and if they fail to do so on two<\/p>\n<p>                  given dates and delay the trial in any manner, their bail will be liable<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        to be cancelled for reasons of misuse.
