Notification  under s.4(1)  of Land  Acquisition Act.<br \/>\n1894(for short, &#8220;the Act&#8221;) was published on October 15, 1959<br \/>\nacquiring 10  acres and\t 12  gunthas  of  land\tsituated  in<br \/>\nJamnagar for  the establishment\t under development  of\tT.B.<br \/>\nHospital. The  appellants laid\ta claim pursuant to the rate<br \/>\nof Rs.\t1,08,898\/- per acre. The Land Acquisition officer in<br \/>\nhis award  dated July  18, 1962\t under s.11 awarded a sum of<br \/>\nRs.2,500\/- per\tacre. Dissatisfied therewith, a Reference to<br \/>\nthe Civil  Judge senior\t division was made under s.18 of the<br \/>\nAct. The  appellants restricted\t their claim  to Rs.2.00 per<br \/>\nsq. ft.\t The Civil  Court enhanced  the compensation  to Rs.<br \/>\n1.25 per  sq. ft. The High Court in the impugned judgment in<br \/>\nthe First  Appeal Nos. 521 and 519 of 1963 dated 28.7.72 set<br \/>\naside the  award and  decree  of  the  Reference  Court\t and<br \/>\nconfirmed that of the Collector. Since the value involved is<br \/>\nmore than  20,000\/- the\t High Court  granted a\tcertificate.<br \/>\nThus these appeals.\n<\/p>\n<p>     The learned  counsel  for\tthe  appellants\t strenuously<br \/>\ncontended that\tEx.39 dated  August 8,\t1959 to an extent of<br \/>\n5016 sq.  ft. land  was sold  by Jaisukhlal  Devji  who\t was<br \/>\nexamined under\tEx. 32,\t for a sum worked out at the rate of<br \/>\nRs. 2.25 per sq. ft. and the High Court was not justified in<br \/>\nrejecting that\tsale  deed.  In\t addition,  he\talso  placed<br \/>\nreliance on  Ex. 38  dated December  6, 1959  of Rs. 2,700\/-<br \/>\nwhich worked  out at the rate of Rs. 2.88 per sq. ft. proved<br \/>\nthrough Lawshankar Monucha Manilal examined under Ex. 28 who<br \/>\nis the son of the vendee. It would also establish, according<br \/>\nto the\tcounsel, that  there is\t a further  increase in\t the<br \/>\nvalue of  the land.  He\t also  buttressed  his\targument  by<br \/>\nreference to Ex. 41 dated July 12, 1990 under which 1200 sq.<br \/>\nft. was\t sold by Vijaykunvarba who was examined as Ex. 176 a<br \/>\nneighbouring  land.   The  High\t Court\ttherefore,  was\t not<br \/>\njustified in  reversing the  award and\tdecree of  the Civil<br \/>\nCourt . We find no force in the contention.\n<\/p>\n<p>     It is  settled law\t that the  claimants like plaintiffs<br \/>\nare entitled  to succeed  for higher  compensation  only  on<br \/>\nproof of  value prevailing  as on  the date of notification.<br \/>\nWhat is\t the prevailing\t market value  as  on  the  date  of<br \/>\nnotification is\t a question of fact to be proved by adducing<br \/>\nevidence. Burden  is always  on him to prove the same. It is<br \/>\nseen that  the appellant  himself purchased the land in 1957<br \/>\nat the\trate of\t Rs.190 per  acre. The\tland adjacent to the<br \/>\nland under acquisition in s.No. 225-I admeasuring 8 acres 39<br \/>\ngunthas was purchased by one Umiyashankar Damodar Vyas under<br \/>\nEx. 55 on August 25, 1960 at the rate of 568 per acre. Ex.39<br \/>\nstrongly relied\t upon by the claimants was executed just two<br \/>\nmonths prior  to the  date of the Notification. It is common<br \/>\nknowledge that\tissuance of  Notification  under  s.4(1)  to<br \/>\nintiate acquisition  would take\t considerable time  and\t the<br \/>\npublecation of\tthe NOtification  under s.4(1)\tof  the\t Act<br \/>\nwould be  made much later on. Having had knowledge, it would<br \/>\nbe obvious that documents would be brought into existence to<br \/>\ninflate the  market value.  Ex. 39  was sought to be pressed<br \/>\ninto service  to inflate the market value. The conclusion of<br \/>\nthe High  Court is  that no attempt was made by the claimant<br \/>\nor the\tvendor or vendee who were examined, to prove Ex.p.39<br \/>\nto prove the distance of the land covered in Ex.p-39 and the<br \/>\nland under acquisition or as a comparable sale. We have seen<br \/>\nthe award  of the  Collector. All  the sales referred in the<br \/>\naward would  only show\tthe sales on acrage basis. Obviously<br \/>\nthe documents  have been brought into existence on the basis<br \/>\nof the\tsq. ft. to inflate higher market value. The property<br \/>\nof 10  acres and  12 gunthas  , when offered for sale in the<br \/>\nopen market,  no  prudent  purchaser  would  be\t willing  to<br \/>\npurchase the  same on  sq. ft. basis. If the small extent of<br \/>\nland in\t a commercial  area, like Nariman point in Bombay or<br \/>\nConnaught Place\t in Delhi is sought to be acquired, perhaps,<br \/>\ndetermination of  the compensation  on the  basis of the sq.<br \/>\nft. may be justified. But when the claimant himself assessed<br \/>\nthe market value at Rs. 190\/- per acre and purchased in 1957<br \/>\nand when  in 1960  the 8 acres and 39 gunthas of nighbouring<br \/>\nland was  sold for  Rs. 568\/- per acre, no prudent purchaser<br \/>\nwould offer  to purchase on square foot basis. This Court in<br \/>\na  catena  of  decisions  deprecated  the  practice  of\t the<br \/>\nreference courts  or High Court to determine market value of<br \/>\nthe lands on sq.ft. basis unless it is established as a fact<br \/>\nthat the  acquired lands  are  situated\t in  already  highly<br \/>\ndeveloped residential  and  industrial\tarea  where  regular<br \/>\nsales are  on sq.ft.  basis. The  High Court  also has given<br \/>\ncogent and  well considered  reasons in\t not  accepting\t the<br \/>\naward and  decree of  the Reference Court.
