Justice S.S.SATHEESACHANDRAN\n\n Dated :29\/07\/2009\n\n O R D E R\n             S.S.SATHEESACHANDRAN, J.\n           -----------------------------\n             W.P.(C).No.21390 OF 2009\n            --------------------------\n        Dated this the 29th day of July 2009\n       -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        Petitioners   are     the   plaintiffs    in<\/p>\n<p>O.S.No.134 of 2005 on the file of the Munsiff&#8217;s<\/p>\n<p>Court, Mananthavady.    Suit is filed seeking a<\/p>\n<p>decree of declaration of title and possession on<\/p>\n<p>the  basis of       prescribing   title  by  adverse<\/p>\n<p>possession,  and  also   for   other   consequential<\/p>\n<p>reliefs.  When  the   defendants,   two  in   number<\/p>\n<p>appeared in the suit, the petitioners\/plaintiffs<\/p>\n<p>raised a contention that they are not the real<\/p>\n<p>defendants  but impersonators.   On the application<\/p>\n<p>moved by the petitioners\/plaintiffs the vakalath<\/p>\n<p>executed  by   the  defendants   with   some   other<\/p>\n<p>documents including a power of attorney was sent<\/p>\n<p>over  to  an    examination.     The  expert,  after<\/p>\n<p>W.P.(C).No.21390 OF 2009     Page numbers<\/p>\n<p>scrutiny of the documents sent a report to the<\/p>\n<p>court.     Petitioners\/plaintiffs filed objection to<\/p>\n<p>that report seeking a fresh enquiry by sending the<\/p>\n<p>documents to another expert.         The defendants also<\/p>\n<p>appeared in person before the court and produced<\/p>\n<p>relevant documents including their voters identity<\/p>\n<p>card to prove their identity.        The learned Munsiff<\/p>\n<p>after     being     satisfied   that     there   was   no<\/p>\n<p>impersonation of the defendants and the           persons<\/p>\n<p>who   appeared     before  the  court    are  really  the<\/p>\n<p>defendants of the suit, declined the requests of<\/p>\n<p>the petitioners\/plaintiffs for a fresh scrutiny of<\/p>\n<p>the vakalath and other documents to a new forensic<\/p>\n<p>expert.       Ext.P6    is the   copy    of that   order.<\/p>\n<p>Propriety     and    correctness   of    that  order   is<\/p>\n<p>challenged in the petition invoking the supervisory<\/p>\n<p>jurisdiction vested with this Court under Article<\/p>\n<p>227 of the Constitution of India.\n<\/p>\n<p>W.P.(C).No.21390 OF 2009    Page numbers<\/p>\n<p>     2.      I  heard   the learned    counsel for the<\/p>\n<p>petitioner.      Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented with reference to Ext.P6 order, I find no<\/p>\n<p>notice to the respondent is necessary and hence it<\/p>\n<p>is dispensed with.       The learned counsel for the<\/p>\n<p>petitioners     submitted  that   though  in  the  writ<\/p>\n<p>petition     challenging   Ext.P6   order  reliefs  are<\/p>\n<p>claimed for sending the documents subjected to<\/p>\n<p>forensic     examination    once    again   by  issuing<\/p>\n<p>appropriate orders \/ directions to the court below,<\/p>\n<p>he is confining his request only for a direction to<\/p>\n<p>the court below to examine the issues raised as<\/p>\n<p>regards the impersonisation of defendants afresh in<\/p>\n<p>the trial of the suit untrammeled by any of the<\/p>\n<p>observations made in Ext.P6 and Ext.P9 orders.        I<\/p>\n<p>fail   to   understand   in  what   way  that  will  be<\/p>\n<p>advantageous to the petitioners \/ plaintiffs in the<\/p>\n<p>suit.    The dispute whether the persons who appeared<\/p>\n<p>before the court are the real defendants has to be<\/p>\n<p>resolved as a preliminarily issue before proceeding<\/p>\n<p>W.P.(C).No.21390 OF 2009    Page numbers<\/p>\n<p>with further steps for the trial of the suit, and<\/p>\n<p>it has nothing to do with the adjudication of the<\/p>\n<p>suit claim or the issues arising for consideration<\/p>\n<p>in the suit.        The court has come to a definite<\/p>\n<p>finding that the persons who appeared before the<\/p>\n<p>court are the defendants and the objections raised<\/p>\n<p>by the petitioners \/ plaintiffs to the contrary are<\/p>\n<p>baseless.     It has also expressed, the opinion that<\/p>\n<p>the attempt of the petitioners in raising such<\/p>\n<p>objections is to prolong and protract the suit and<\/p>\n<p>that being so I find no direction can be given to<\/p>\n<p>the court to reexamine that question again.<\/p>\n<p>          3.    The facts and circumstances presented<\/p>\n<p>in the case give strong credence to the opinion<\/p>\n<p>formed by the learned Munsiff that the petitions<\/p>\n<p>moved by the petitioners are intended to delay the<\/p>\n<p>adjudication of the disputes and a decision in the<\/p>\n<p>suit with finality. Statements made in the writ<\/p>\n<p>petition also show that several other petitions<\/p>\n<p>moved by the petitioners are also pending for<\/p>\n<p>W.P.(C).No.21390 OF 2009     Page numbers<\/p>\n<p>consideration before the court below.         Needless to<\/p>\n<p>point out, if the petitions are found prima facie<\/p>\n<p>frivolous and intended to delay the trial of the<\/p>\n<p>suit, it shall be disposed by passing appropriate<\/p>\n<p>orders imposing heavy terms.           Parties to a lis<\/p>\n<p>cannot    stall    the   trial  when    litigants  having<\/p>\n<p>genuine cause are clamouring for ventilating their<\/p>\n<p>grievances and the time of the court being so<\/p>\n<p>limited    and   precious   it  has    to  be  profitably<\/p>\n<p>applied with the avowed object to dispense and<\/p>\n<p>advance justice.
