Justice M.SASIDHARAN NAMBIAR\n\n Dated :06\/08\/2009\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.1510 of 2006\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    First accused in C.C.No.333\/2002 on the file of<\/p>\n<p>Judicial First Class Magistrate&#8217;s Court, Kolenchery<\/p>\n<p>filed this petition under Section 482 of Code of<\/p>\n<p>Criminal Procedure to quash Annexure-D order passed by<\/p>\n<p>the Magistrate on 13.2.2006, holding that as cognizance<\/p>\n<p>was taken against the petitioner, filing of a further<\/p>\n<p>report, after re-investigation under Section 173(8) of<\/p>\n<p>Code  of  Criminal  Procedure,  will  not  affect   the<\/p>\n<p>cognizance already taken and therefore, proceedings as<\/p>\n<p>against the petitioner is to be continued.<\/p>\n<p>    2.   Based on the final report submitted after<\/p>\n<p>investigation under Section 173(2) of Code of Criminal<\/p>\n<p>Procedure  dated   23.1.2002,   Judicial  First   Class<\/p>\n<p>Magistrate, Kolenchery took cognizance of the offences<\/p>\n<p>under Sections 143, 147, 148, 452, 354 and 427 read<\/p>\n<p>with Section 149 of Indian Penal Code as against seven<\/p>\n<p>accused.  Subsequently, in O.P.No.3567\/2002, filed by<\/p>\n<p>the petitioner, under Anenxure-A judgment, this Court<\/p>\n<p><span class=\"hidden_text\">CRMC 1510\/06                 2<\/span><\/p>\n<p>directed    that  investigation  of  Crime  Nos.248\/2000,<\/p>\n<p>249\/2000,    250\/2000,   115\/2001,  116\/2001,   117\/2001,<\/p>\n<p>118\/2001 and 119\/2001 are to be conducted by the<\/p>\n<p>Superintendent    of  Police,  Crime  Branch,  Ernakulam.<\/p>\n<p>After completing the further investigation so ordered,<\/p>\n<p>a final report was submitted as provided under Section<\/p>\n<p>173(8) of Code of Criminal Procedure stating that out<\/p>\n<p>of the original accused, accused 1, 5 and 6 are not<\/p>\n<p>involved    in  the  case  and  including the  remaining<\/p>\n<p>original accused only eleven accused are involved. When<\/p>\n<p>petitioner    contended that   he  cannot  be prosecuted<\/p>\n<p>further, in view of the final report, under Annexure-D<\/p>\n<p>order dated 13.3.2006, learned Magistrate, following<\/p>\n<p>the decision of the Apex Court in <a href=\"\/doc\/549946\/\">Adalat Prasad v.<\/p>\n<p>Rooplal Jindal<\/a> (2004 (3) KLT 382), held that once<\/p>\n<p>cognizance is taken, case as against the petitioner is<\/p>\n<p>to be proceeded further.      This petition is filed to<\/p>\n<p>quash the said order.\n<\/p>\n<p>    3. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    4. The facts are undisputed.      Though, as per the<\/p>\n<p>original final report filed under Section 173(2) of<\/p>\n<p><span class=\"hidden_text\">CRMC 1510\/06               3<\/span><\/p>\n<p>Code of Criminal Procedure cognizance was taken against<\/p>\n<p>seven accused including the petitioner, dissatisfied<\/p>\n<p>with the investigation, this Court directed a further<\/p>\n<p>investigation to be conducted by the Superintendent of<\/p>\n<p>Police, Crime Branch, Ernakulam. After the said further<\/p>\n<p>investigation, a final report as provided under Section<\/p>\n<p>173(8), which is to be treated as a final report<\/p>\n<p>submitted under Section 173(2) of Code of Criminal<\/p>\n<p>Procedure, was filed stating that accused 1,5 and 6 are<\/p>\n<p>not   involved    in  the  case.   Therefore,   learned<\/p>\n<p>Magistrate, even if, proceeded with trial of those<\/p>\n<p>accused,    they  can  only  be  acquitted.   In   such<\/p>\n<p>circumstances, it is not, in the interest of justice,<\/p>\n<p>to continue the proceedings as against the petitioner<\/p>\n<p>and accused 5 and 6. Though learned Magistrate relied<\/p>\n<p>on the decision in Adalat Prasad&#8217;s case (supra), that<\/p>\n<p>was a case where, summons issued under Section 204 of<\/p>\n<p>Code of Criminal Procedure by the Magistrate, after<\/p>\n<p>conducting an inquiry under Section 202 of Code of<\/p>\n<p>Criminal    Procedure, was  later  withdrawn,  at   the<\/p>\n<p>instance of the accused.  Honourable Supreme Court held<\/p>\n<p>that Magistrate has no power to withdraw the summons<\/p>\n<p><span class=\"hidden_text\">CRMC 1510\/06               4<\/span><\/p>\n<p>issued under section 204 of Code of Criminal Procedure<\/p>\n<p>and the remedy is to invoke the provisions of Section<\/p>\n<p>482 of Code of Criminal Procedure. When, based on the<\/p>\n<p>unsatisfactory investigation, a further investigation<\/p>\n<p>was   ordered  by  this  Court  and   on  such  further<\/p>\n<p>investigation, it is found that petitioner is not<\/p>\n<p>involved in the case, continuation of the proceedings<\/p>\n<p>as against the petitioner is only an abuse of process<\/p>\n<p>of   the    court.  In   such  circumstances,   further<\/p>\n<p>proceedings    in  C.C.No.333\/2002   as   against   the<\/p>\n<p>petitioner and accused 5 and 6 would only be an abuse<\/p>\n<p>of process of the court, as, even if they are tried,<\/p>\n<p>there is no chance for convicting them.
