This
\n\tCourt has passed an order on 15\/9\/2010, which is quoted as under:\n<\/p>\n

\nfor respondent No.1, learned
\nAdvocate General Mr.Kamal Trivedi with learned AGP Ms.Sangeeta Vishen

\nrespondent No.3.\n<\/p>\n
\tToday, when the
\nmatter is taken up for hearing, learned Senior Advocate Mr.Mihir
\nJoshi made a voluntary statement without prejudice to the rights and
\ncontentions of petitioners that petitioners are prepared to furnish
\nbank guarantee for a period of one year as per the requirement of
\nrespondent No.1   GETCO.\n<\/p>\n
\tLearned advocate
\nMr.Premal Joshi appearing for respondent No.1 requests for some tome
\nto have the instructions on this statement from respondent No.1.\n<\/p>\n
\tAccordingly, the
\nmatter is adjourned to 23.9.2010.\n<\/p>\n
Today,
\n\tlearned advocate Mr. Damani placed on record affidavit in response
\n\tto letter dated 21\/9\/2010 issued by GETCO.  Copy thereof is served
\n\tto other side, therefore, same is taken on record.  The averment
\n\tmade in aforesaid affidavit in para 1 and 2 which are quoted as
\n\tunder:\n<\/p>\n
\t 1.\tI say that
\n\tthe petitioner has stated that without prejudice to its rights and
\n\tcontentions it was willing to furnish a bank guarantee as per
\n\tformate accepted by the respondent from other units\/companies. This
\n\twas recorded in an order dated 15\/9\/2010 and also reiterated in its
\n\tletter dated 15\/9\/2010 written by the petitioner company to the
\n\tGETCO.  Annexed hereto and marked as Annexure I is the copy of the
\n\tletter dated 15\/9\/2010 issued by the petitioner.\n<\/p>\n
2.\tI
\n\tsay and submit that the petitioner has now received a letter from
\n\tthe respondent dated 21\/9\/2010 which imposes additional conditions
\n\ton the petitioner.  I state that the issue can not be kept for
\n\tre-adjudication by the GERC as observed by the respondent and the
\n\tterm of the bank guarantee should be as accepted by the respondent
\n\tfrom other units\/companies, as per their normal format which has
\n\tbeen annexed along with the letter dated 15\/9\/2010.\n<\/p>\n
The
\n\tformate which has been annexed to aforesaid affidavit page 320 Item
\n\tno. 2 where Bank Guarantee is required to be given by petitioner to
\n\tGETCO for a period of one year from date on which it having
\n\teffective and within one year period petitioner has to complete work
\n\tand to generate power.  The relevant Item no. 2 is quoted as under:\n<\/p>\n
\t Whereas the
\n\tVendor has assured the GETCO that the arrangement would be made at
\n\tthe site for completing the work of laying the —- Kms lines, Byas
\n\tand all other work approved vide GETCO’s letter dated —-. For
\n\twhich the estimate has been paid and work will be completed within
\n\tone year from the date on which Bank Guarantee is given by
\n\tpetitioner.  If the work is delayed beyond date on which Bank
\n\tGuarantee is given on completion of one year, from that date, Bank
\n\tGuarantee is valid for encashing by GETCO.\n<\/p>\n
After
\n\tdiscussing item no. 2 as referred above, it is made clear between
\n\tall parties that work will be completed within one year period from
\n\tthe date of giving Bank Guarantee.  Meaning thereby that during this
\n\tone year period after completing work, petitioner must have to
\n\tgenerate power and inject within a period of one year from the date
\n\ton which Bank Guarantee is given.\n<\/p>\n
Learned
\n\tadvocate Mr. Karia submitted that let petitioner may approach to
\n\trespondent no. 3 Gujarat Electricity Regulatory Commission for
\n\taccepting Bank Guarantee by GETCO.  After receiving such application
\n\tfrom petitioner, respondent no. 3 Gujarat Electricity Regulatory
\n\tCommission will pass necessary order after receiving No Objection
\n\tfrom GETCO.\n<\/p>\n
In
\n\tlight of aforesaid submission made by all learned advocates
\n\tappearing on behalf of respective parties and whatever arrangement
\n\tmade as referred above, it is directed to each respective party to
\n\tabide it and this exercise is required to be completed by parties
\n\twithin a period of two months from date of receiving copy of present
\n\torder.  It is made clear by this Court that aforesaid arrangement
\n\tand order passed by this Court is without prejudice to rights and
\n\tcontention of each respective party with a direction to petitioner
\n\tto give Bank Guarantee within a period of two months to GETCO.\n<\/p>\n
In
\n\tlight of this back ground, whatever earlier adverse order is passed
\n\tby GETCO against present petitioner, will not come in way of
\n\tpetitioner.\n<\/p>\n
In
\n\tview of above observation and direction, present petition is
\n\tdisposed of by this Court without expressing any opinion on merits
\n\twith a liberty to approach by concern party to this Court in case of
\n\tany difficulty.\n<\/p>\n
