I\\Io.307\/2010 passed by the Additionai I civil\n\nA Vi0judg\u00a2sIgt*~Iv:;zg'o:e and the order dated 18.08.2010 in M.A.24\/2010\n\npassed  dditionai Senior Civil Iudge and CIM, Mysore.\n\n2. First respondent is the plaintiff, second respondent is<\/pre>\n<p>the first defendant and the petitioner is the second defendant<\/p>\n<p>9&#8243;&#8221;\n<\/p>\n<p> &#8216;  .. xi <\/p>\n<p>before the Trial Court. In this order for convenience the p_arties<\/p>\n<p>are referred to their status before the Trial Court.<\/p>\n<p>3. Plaintiff contends that she is:.thejj.o&#8217;wner&#8217; <\/p>\n<p>bearing No.2851 and 2851\/A&#8221;siit1_atedilatiii <\/p>\n<p>Mohalla, Mysore. On   slide 6&#8217;f&#8217;t  schedule<br \/>\nproperty the second defendant bearing door<br \/>\nNo.2849. In l3e\ufb02a;e&#8217;s3n  &#8220;there is a lane as<br \/>\ndescribed   defendant is putting<br \/>\nup  andlmade some encroachment on<\/p>\n<p>the &#8216;A&#8217; sched-t1_le.iii&#8217; by this act of second defendant<\/p>\n<p> V.   Oi.S&#8217;;&#8217;No_,3_07\/ 2010 for mandatory injunction to cancel<\/p>\n<p>  license.in._:fa\\{our of the defendant and for other reliefs. The<\/p>\n<p>&#8220;irial  appreciating the pleadings, affidavits and the<\/p>\n<p> r.docunients produced by both the parties passed the impugned<\/p>\n<p>:7-order on 22.4.2010 as per Annexure&#8211;B granting an order of<\/p>\n<p>temporary injunction restraining the second defendant from<\/p>\n<p>9&#8221;-u<\/p>\n<p>\ufb02it.\n<\/p>\n<p>putting up any construction on property bearing No.284.9 fully<\/p>\n<p>described in B schedule of the plaint. Aggrieved by this ordervvof<\/p>\n<p>the Trial Court, the second defendant filed an   <\/p>\n<p>lower appellate court in M.A.24\/20181;; finder&#8217; the <\/p>\n<p>at Annexure-A dated 18.8.2019, theilower <\/p>\n<p>dismissed the appeal filed by the  and the order<\/p>\n<p>passed by the Trial Cotittf if-lye.nce this  petition.<\/p>\n<p>entiregwrit   v\n<\/p>\n<p>5.   It_isl&#8221;not in that the property of plaintiff and<\/p>\n<p>the&#8217;l&#8217;\u00abseco&#8217;ndv defendantware adjacent to each other. According to<\/p>\n<p>  the&#8217; plainltiff&#8217;,&#8217;i:he- second defendant has encroached on the lane &#8216;A&#8217;<\/p>\n<p>sAc~hedu_le.pri::perty and constructing a building. Before the lower<\/p>\n<p> appellate court, the second defendant filed an affidavit stating that<\/p>\n<p>he &#8216;yvill not put up construction to an extent of 31\/2 feet on the<\/p>\n<p> northern side of his property bearing 2849, that is, on the lane &#8216;A&#8217;<\/p>\n<p>.&#8221;&#8216;~c<\/p>\n<p>did<\/p>\n<p>schedule property. Though the lower appellate court noticed the<\/p>\n<p>affidavit filed by the second defendant failed to consider thetlsaine.<\/p>\n<p>The grievance of the plaintiff is that the second_.-deifendantl  _<\/p>\n<p>making construction on the lane measuring I31\/2&#8243; sittiatecl V<\/p>\n<p>between the properties belonging to the <\/p>\n<p>Now that the second defendant hlaspffiled aniaffidavit stating that<br \/>\nhe will not put up constrti&#8221;ction&#8217;lion_ yti&#8217;1e._pl.ane. measuring 31\/2 feet<br \/>\nbetween the properties of..second..defendant:and plaintiff, then<br \/>\nthe plaintiff &#8216;cai:;notllifiave&#8221;&#8216;a.ny objection for the second defendant<br \/>\nto put up\u00abconstruction~inproperty bearing No.2849. Even before<\/p>\n<p>me the learned wcoiinsel for fhe second defendant submits that the<\/p>\n<p>,s&#8217;e::ond defendant will not put up construction on the 31\/2 width<\/p>\n<p>fe,\u20acl.t&#8217;*&#8211;lane.&#8217; ll.The&#8217;g;;.snbmission of the learned counsel for the second<\/p>\n<p> defendant is &#8216;placed on record. ln view of this development, the<\/p>\n<p>&#8220;f&#8211;f_Airnp\ufb01gned orders passed by both the courts below requires<\/p>\n<p>  V.  modification.
