In the meantime, respondent No.3 filed the impugned<br \/>\napplication below Exh.47 for impleading them as party defendant in<br \/>\nthe suit. The said application was opposed but the Court below<br \/>\nallowed the said application which has given rise to the present<br \/>\npetition.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the petitioner has mainly contended that the Court below<br \/>\nhas not considered the reply filed by the petitioner and the<br \/>\nauthorities cited by petitioner and if the respondent No.2\/1 to 2\/4<br \/>\nare allowed to be joined as party defendant in the suit it will<br \/>\nchange the entire nature of the suit.  Learned Advocate for the<br \/>\npetitioner has relied upon the decision of the Supreme Court in the<br \/>\ncase of  Mumbai International Airport Pvt. Ltd. Vs. Regency<br \/>\nConvention Centre &amp; Hotels Pvt Ltd. &amp; Ors.,<br \/>\nreported<br \/>\nin  AIR 2010 SC 3109<br \/>\nHe submitted that the order of the Court below may be quashed and set<br \/>\naside.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned Advocate for the petitioner and having perused the<br \/>\norder impugned in the petition, this Court is in complete agreement<br \/>\nwith the findings recorded and conclusion arrived at by the Court<br \/>\nbelow.  This Court is of the opinion that there is a previty of<br \/>\ncontract between the parties and therefore proper adjudication of the<br \/>\nsuit, respondent No.3 herein is proper and necessary party.\n<\/p>\n<p>5.\t\tSo<br \/>\nfar as the decision of the Hon&#8217;ble Apex Court as relied upon by the<br \/>\nlearned Advocate for the petitioner is concerned, paragraph No.12.2<br \/>\nand 12.3 set out that for determining the actual possession in the<br \/>\nsuit for specific performance, necessary party may be permitted to be<br \/>\njoined as party defendant in the suit, which reads as under:\n<\/p>\n<p>&#8220;12.2)<br \/>\nIf the owner of a tenanted property enters into an agreement for sale<br \/>\nof such property without physical possession, in a suit for specific<br \/>\nperformance by the purchaser, the tenant would not be a necessary<br \/>\nparty. But if the suit for specific performance is filed with an<br \/>\nadditional prayer for delivery of physical possession from the tenant<br \/>\nin possession, then the tenant will be a necessary party in so far as<br \/>\nthe prayer for actual possession.\n<\/p>\n<p>12.3)<br \/>\nIf a person makes an application for being impleaded contending that<br \/>\nhe is a necessary party, and if the court finds that he is a<br \/>\nnecessary party, it can implead him. If the plaintiff opposes such<br \/>\nimpleadment, then instead of impleading such a party, who is found to<br \/>\nbe a necessary party, the court may proceed to dismiss the suit by<br \/>\nholding that the applicant was a necessary party and in his absence<br \/>\nthe plaintiff was not entitled to any relief in the suit.&#8221;\n<\/p>\n<p>6.\t\tI<br \/>\nam of the opinion that allowing the respondent No.3 as party<br \/>\ndefendant in the suit, would not prejudice to the right of the<br \/>\npetitioner as a plaintiff in the suit.  The petition is devoid of<br \/>\nmerits and requires to be dismissed.  Accordingly, the petition is<br \/>\ndismissed with no order as to costs.
