(C) No. 24675 of 2005)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>Leave granted.\n<\/p>\n<p>Challenge in this appeal is to the judgment rendered<br \/>\nby a learned Single Judge of the Bombay High Court<br \/>\nallowing prayer made by respondent No.1 for certain<br \/>\ndirections and directing to have a fresh meeting of  Sri<br \/>\nLohana Mahaparishad (hereinafter referred to as the<br \/>\n&#8216;Mahaparishad&#8217;).\n<\/p>\n<p>A brief reference as projected by the appellant to the<br \/>\nfactual aspects would suffice.\n<\/p>\n<p>A suit was filed relating to the function of<br \/>\nMahaparishad.  On the basis of the consent order i.e. in<br \/>\nan appeal from the order No.427\/2005 the High Court<br \/>\ndirected to have a General Body Meeting containing 23<br \/>\nAgendas including the agenda for holding the election of<br \/>\nPresident of the Mahaparishad and four trustees. The suit<br \/>\nwas accordingly disposed of.  A Court Commissioner was<br \/>\nappointed and the agenda notice containing the details of<br \/>\n23 agenda items were circulated to more than 650<br \/>\nmembers and the meeting was fixed at Ahmedabad on<br \/>\n3.7.2005. The meeting of the Madhyastha Maha Samiti (in<br \/>\nshort &#8216;Maha Samiti&#8217;) of Mahaparishad was held.  On the<br \/>\nrequest of majority of members, item no.9 pertaining to<br \/>\nthe election of four trustees in place of the retiring<br \/>\ntrustees and agenda no.22 pertaining to election of the<br \/>\nPresident was taken up first after first formal agendas.<br \/>\nShri Jayantilal Govindji Kundalia was elected as a<br \/>\nPresident and four persons including one T.R. Chitwani<br \/>\nwere elected as trustees. It is to be noted that in the<br \/>\nelection for the post of President and trustees both Shri<br \/>\nKundalia and Shri Chitwani were contesters.  As noted<br \/>\nearlier Shri Kundalia was elected as President while Shri<br \/>\nChitwani was elected as a trustee.  Respondent no.1 Sri<br \/>\nBhupendra P. Popat was the Chief Polling Agent of Shri<br \/>\nChitwani.  It is not disputed that considering the paucity<br \/>\nof time the meeting was adjourned for consideration of the<br \/>\nremaining agenda items at the later date.  According to<br \/>\nappellant after due notice to all the members the meeting<br \/>\nwas held on 4.9.2005 and the remaining items of agenda<br \/>\nwere considered and adopted.  Respondent no.1 Sri<br \/>\nBhupendra P. Popat filed an application making grievance<br \/>\nthat the decision could not have been taken at a<br \/>\nsubsequent meeting and it was only the earlier Board<br \/>\nwhich could have taken up the remaining agenda items<br \/>\nand not the newly elected governing body.  The appellant<br \/>\nquestioned correctness of the acceptability of the stand of<br \/>\nthe respondent no.1. It was highlighted that after the new<br \/>\ngoverning body was elected, the question of the old body<br \/>\nwhose  term had expired on 31.12.2004 could not have<br \/>\ntaken any decision. The High Court accepted that the old<br \/>\ngoverning body was the only body which could have taken<br \/>\nthe decision so far as the remaining items of the agenda<br \/>\nare concerned and, therefore, there was violation of the<br \/>\nspecific order as contained in the consent order.\n<\/p>\n<p>Learned counsel for the appellant submitted that the<br \/>\nHigh Court has clearly fallen into error by holding that it<br \/>\nwas the old body which had to take the decision.  That<br \/>\nwould  put the clock back and process of the election of<br \/>\nthe new body would be an exercise in futility.  In fact,<br \/>\nthere was a meeting held on 4.9.2005 where after due<br \/>\nnotice to eligible persons, decisions were taken.<br \/>\nRespondent no.1 Sri Bhupendra P. Popat at the behest of<br \/>\nShri Chitwani who lost presidential election had filed<br \/>\napplication in a  disposed of case. The High Court had<br \/>\nerroneously entertained the application.<br \/>\nIn response, learned counsel for the respondents<br \/>\nheld that various vital agenda items were to be<br \/>\nconsidered.  It was only the old governing body which had<br \/>\ntaken various resolutions which were to be discussed in<br \/>\nterms of various agenda items and the new governing<br \/>\nbody had no role to play so far as these items are<br \/>\nconcerned.\n<\/p>\n<p>We find that the High Court failed to consider two<br \/>\nvery relevant aspects.  Firstly, the scope of re-opening the<br \/>\nentire matter in the case after passing of the consent<br \/>\norder was required to be considered.  Secondly, it has<br \/>\nfailed to consider the effect of the decisions\/resolutions<br \/>\ntaken at the meeting held on 4.9.2005. It is the stand of<br \/>\nthe appellant that due notice was given to the<br \/>\nrespondents and all eligible members and the resolutions<br \/>\nwere adopted after thorough discussion.\n<\/p>\n<p>We do not think it proper to say anything about the<br \/>\neffect of the resolutions\/decisions.  It would be<br \/>\nappropriate for the High Court to consider the<br \/>\nmaintainability of the application filed by respondent no.1<br \/>\nin the matter and the effect of resolutions taken on<br \/>\n4.9.2005, if it comes to hold that the application was<br \/>\nmaintainable.  Accordingly, we remit the matter to the<br \/>\nHigh Court for fresh consideration of the aforesaid two<br \/>\naspects for which we express no opinion.\n<\/p>\n<p>Since the matter is of urgency, we request the High<br \/>\nCourt to dispose of the matter within three months from<br \/>\nthe date of receipt of order.\n<\/p>\n<p>The appeal is disposed of accordingly with no order<br \/>\nas to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Nanshibhai S\/O Ganeshbhai Mirani vs Bhupendra P.
