GOVERNMENT PLEADER for Respondent(s) :\n4, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 04\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.<br \/>\nIn present petition the petitioner seeks below mentioned relief\/s:\n<\/p>\n<p>&#8220;20.(A)<br \/>\nYOUR LORDSHIPS may be pleased to allow this petition and issue a writ<br \/>\nof mandamus or any other appropriate writ, order or direction for (i)<br \/>\nquashing  the circular dated 3.8.2007 of the Gujarat Urja Vikas Nigam<br \/>\nLimited at Annexure &#8216;C&#8217; qua the prescription of a condition to adopt<br \/>\nthe drip irrigation system for getting reconnection after a period of<br \/>\nfive years, (ii) quashing the order of the Ombudsmen of Electricity<br \/>\ndated 11.1.2008 at annexure-C qua the imposition of a condition for<br \/>\napplying for the drip irrigation system by the petitioner before the<br \/>\nreconnection is made and (iii) giving the reconnection to the<br \/>\npetitioner on priority basis.\n<\/p>\n<p>(B)<br \/>\nYOUR LORDSHIPS be pleased to issue any other relief\/s as deemed fit<br \/>\njust and proper in the facts and circumstances of this case.&#8221;\n<\/p>\n<p>2.<br \/>\nWhen the petition is taken up for hearing learned advocate for the<br \/>\npetitioner is not present.\n<\/p>\n<p>3.<br \/>\nHeard Mr. Bhatt, learned advocate for the respondent No.2 and 3.\n<\/p>\n<p>4.<br \/>\nMr. Bhatt, learned advocate for the respondent Nos.2 and 3 has placed<br \/>\non record a copy of the letter dated 4.10.2008 which is signed by<br \/>\nExecutive Engineer (Operations) Pashchim Gujarat Vij Company Limited,<br \/>\nDivision No.2, Amreli intimating that in view of certain developments<br \/>\nwhich took place at the site<br \/>\nduring 12.8.2008 and 1.9.2008 and pursuant to another application<br \/>\ndated 16.9.2008 submitted by the petitioner to provide electricity<br \/>\nsupply connection in respect of the same survey number however on<br \/>\nanother bore-well, the<br \/>\npetitioner has, upon completion of all formalities on 25.9.2008,<br \/>\ngranted electricity supply connection i.e. his electricity supply<br \/>\nconnection has been restored with effect from 27.9.2008. The said<br \/>\nletter dated 4.10.2008 is taken on record.\n<\/p>\n<p>5.<br \/>\nAs noted above, there is no one present on behalf of the petitioner<br \/>\neither to oppose the stipulation made in the letter dated 4.10.2008<br \/>\nor to claim that electricity supply connection is not restored.\n<\/p>\n<p>6.<br \/>\nTherefore, in view of the aforesaid letter dated 4.10.2008, it<br \/>\nappears that the petitioner&#8217;s request for electricity supply<br \/>\nconnection is complied with and purpose of present petition has been<br \/>\nserved and that therefore the petition is rendered infructuous in<br \/>\nview of the letter dated 4.10.2008.\n<\/p>\n<p>7.<br \/>\nWith the aforesaid clarification the petition stands disposed of as<br \/>\nhaving become infructuous.\n<\/p>\n<p>8.<br \/>\nIt is however clarified that since present order is passed in absence<br \/>\nof the learned advocate for the petitioner it would be open to the<br \/>\npetitioner to file appropriate application requesting revival of the<br \/>\npetition in the event the factual aspects are different than what is<br \/>\nstated in the letter dated 4.10.2008.\n<\/p>\n<p>(K.M.TAHKER,J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Pragjibhai vs The on 4 April, 2011 Author: K.M.Thaker,&amp;Nbsp;
