No.24084 of 2010\n                           GODIL YADAV, son of Congress Yadav\n                                            Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>6\/   21.01.2011            Heard learned counsel for the parties.<\/p>\n<p>                               The petitioner, who is husband of the deceased Tanika<\/p>\n<p>                  Devi, is an accused in a case under Section 304 (B) of the Indian<\/p>\n<p>                  Penal Code<\/p>\n<p>                               The informant stated in the First Information Report<\/p>\n<p>                  that on receipt of information, he went to his daughter&#8217;s Sasural<\/p>\n<p>                  where he found his daughter in an unconscious stage. All of them<\/p>\n<p>                  including the petitioner took the victim to Referal Hospital,<\/p>\n<p>                  Bounsi. The doctor at Bounsi referred the patient (victim) to<\/p>\n<p>                  Bhagalpur, where she died during the course of treatment. The<\/p>\n<p>                  informant learnt that accused persons used to assault her for non-<\/p>\n<p>                  fulfillment of demand of Motorcycle. The informant believes that<\/p>\n<p>                  the accused persons have killed his daughter by administering<\/p>\n<p>                  poison.\n<\/p>\n<p>                               Counsel for the petitioner submits that it would appear<\/p>\n<p>                  from the prosecution case that the girl had not earlier complained<\/p>\n<p>                  about either demand of dowry or torture. He further submits that it<\/p>\n<p>                  would appear from the First Information Report that the informant<\/p>\n<p>                  learnt about the alleged torture and demand of dowry after her<\/p>\n<p>                  death. He further submits that charge-sheet has been submitted<\/p>\n<p>                  under Section 306 of the Indian Penal Code. He further submits<\/p>\n<p>                  that the Viscera report, as called for by the Court, has been<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        received. The petitioner is in custody since 04.03.2010.<\/p>\n<p>                    Counsel for the State submits that the Viscera report<\/p>\n<p>        shows the presence of poisonous element in the body of the<\/p>\n<p>        deceased.\n<\/p>\n<p>                    Having regard to the facts and circumstances of the<\/p>\n<p>        case, I am not inclined to grant bail to the petitioner for the<\/p>\n<p>        present. His prayer for bail is rejected.
