Rajgrihar, Addl.S.C.\n<\/p>\n<p>                                      &#8212;&#8212;\n<\/p>\n<p>\n5   08\/07\/2010               After having heard learned counsel for the<\/p>\n<p>                   petitioner as well as learned counsel for the State, this Court<\/p>\n<p>                   is not convinced about the submission made at the Bar that<\/p>\n<p>                   the pay scale given to the petitioner and the order passed by<\/p>\n<p>                   the respondents contained in letter No. 1966 dated 24.7.2003<\/p>\n<p>                   contained in Annexure-7 really falls foul of any law.<\/p>\n<p>                             However, there is insistence on behalf of the<\/p>\n<p>                   learned counsel for the petitioner that looking at the higher<\/p>\n<p>                   qualification which the petitioner had at the time of<\/p>\n<p>                   appointment in the department which he had served, he was<\/p>\n<p>                   entitled to a pay scale higher than the Bill Clerks of other<\/p>\n<p>                   department.    Since there was no recommendation of a<\/p>\n<p>                   replacement pay scale of the kind which would have<\/p>\n<p>                   accommodated the petitioner&#8217;s interest there is some<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>       provision made in this regard, according to him, in resolution<\/p>\n<p>       no. 660\/F\/2 issued by the Finance Department dated 8.2.1999<\/p>\n<p>       which is paragraph 21 of the said resolution.<\/p>\n<p>                Let the petitioner take his chance with the State<\/p>\n<p>       authorities a second time over if he is so convinced about the<\/p>\n<p>       applicability of paragraph 21 in his case.
