No.36256 of 2010\n                                SATYA NARAIN SINGH\n                                           Versus\n                                 THE STATE OF BIHAR\n\n3   10.12.2010<\/pre>\n<p>            Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned counsel for the state assisted by learned counsel for<\/p>\n<p>                 the informant.\n<\/p>\n<p>                          Petitioner is named in the FIR with specific allegation<\/p>\n<p>                 that he alongwith one, co-accused, Vinod Singh committed<\/p>\n<p>                 murder of Manoj Kumar by opening indiscriminate firing while<\/p>\n<p>                 the aforesaid, Manoj Kumar was coming to Patna by his<\/p>\n<p>                 motorcycle.\n<\/p>\n<p>                          The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the name of this petitioner surfaced in this case on the<\/p>\n<p>                 basis of so-called oral dying declaration of the deceased but as<\/p>\n<p>                 a matter of fact, the alleged occurrence took place on<\/p>\n<p>                 18.09.2009 and the deceased was taken to PMCH, Patna on<\/p>\n<p>                 the same day but the FIR was lodged on 19.09.2009. There is<\/p>\n<p>                 no explanation as to why the FIR was not recorded on<\/p>\n<p>                 18.09.2009,      particularly   in   the   circumstance,   when   the<\/p>\n<p>                 deceased had already stated the name of the petitioner not only<\/p>\n<p>                 before the informant but also before one police official of<\/p>\n<p>                 Garkha Police Station.\n<\/p>\n<p>                          The perusal of case diary shows that on the alleged<\/p>\n<p>                 date of occurrence, when the police rushed at the place of<\/p>\n<p>                 occurrence having got the information of incident, the injured<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>        had already been taken to Patna for treatment. Subsequently,<\/p>\n<p>        one S.I., Sri Ram Mishra, went to PMCH and he came to know<\/p>\n<p>        that the injured has been taken to operation theatre.    The S.I.<\/p>\n<p>        met the injured who, anyhow, disclosed the name of the<\/p>\n<p>        petitioner as well as other accused as his assailants but the<\/p>\n<p>        statement of injured could not be recorded. Subsequently, when<\/p>\n<p>        the injured died, the statement of informant was recorded.<\/p>\n<p>                 In my view, the points, which have been raised by the<\/p>\n<p>        Learned counsel for the petitioner, may be considered at the<\/p>\n<p>        time of trial and it would not be proper for prosecution to reply<\/p>\n<p>        the above-said points, at least, at this stage.<\/p>\n<p>                 In the aforesaid circumstances, I am not inclined to<\/p>\n<p>        grant privilege of bail to the petitioner. Accordingly, prayer for<\/p>\n<p>        bail of the petitioner, Satya Narain Singh, in connection with<\/p>\n<p>        Garkha P.S.
