Dabhi, learned APP, waives service of notice of rule on<br \/>\nbehalf of the respondent State of Gujarat.\n<\/p>\n<p>2\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3\t\tThe<br \/>\napplicant- convict prisoner, who, by judgement and order dated<br \/>\n23.4.2005 rendered in Sessions Case No. 7 of 2004,  passed by learned<br \/>\nAdditional Sessions Judge, Ahmedabad, has been convicted for the<br \/>\noffence punishable under Section 302 of the Indian Penal Code and<br \/>\nother offences and sentenced to life imprisonment, has filed this<br \/>\napplication praying to enlarge him on temporary bail for a period of<br \/>\n15 days to enable to enable him to perform the marriage ceremony of<br \/>\nhis son Sanjaykumar which is scheduled on 28.11.2010 at Ahmedabad.\n<\/p>\n<p>4\t\tWe<br \/>\nhave gone through the application and the supporting documents that<br \/>\nform part of the application and have considered the submissions<br \/>\nadvanced by Ms. Jayshree Bhatt, learned advocate for the applicant<br \/>\nand Mr. Dabhi, learned APP, for the respondent Satate of Gujarat. We<br \/>\nhave also gone through the jail remarks sheet forwarded by the jail<br \/>\nauthority.\n<\/p>\n<p>5\t\tUpon<br \/>\nperusal of the jail remarks sheet, we find that the applicant has<br \/>\nundergone more than 5 years imprisonment as against the imprisonment<br \/>\nfor life. During the said period, he has not availed any temporary<br \/>\nbail. However, he has availed furlough leave on three occasions and<br \/>\nsurrendered in time. That apart, there is no jail punishment. His<br \/>\nconduct in jail is good. Besides, his presence for performing<br \/>\nmarriage ceremony of his son Sanjaykumar is genuine. In view of the<br \/>\naforesaid, if the applicant-convict is released on temporary bail for<br \/>\na period of two weeks from the date of his actual release, the same<br \/>\nwould meet the ends of justice.\n<\/p>\n<p>6\t\tFor<br \/>\nforegoing reasons, the application succeeds and accordingly, it  is<br \/>\nallowed. The applicant-convict prisoner Shailesh alias Chaliyo<br \/>\nChaturbhai Dantani is ordered to be released on temporary bail for a<br \/>\nperiod of 15 days from the date of his actual release on executing a<br \/>\npersonal bond of Rs. 5,000\/- before the jail authority on usual terms<br \/>\nand conditions. The applicant-convict shall surrender to the jail<br \/>\nauthority on completion of 15 days from the date of his actual<br \/>\nrelease without fail. During the period of temporary bail, the<br \/>\napplicant-convict shall not abuse the liberty granted to him and<br \/>\nshall maintain law and order.\n<\/p>\n<p>7.\t\tRule<br \/>\nis made absolute accordingly.
