(Crl.) 5409 of 2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by the<br \/>\nDivision Bench of the Bombay High Court dismissing the writ<br \/>\npetition filed by the appellant.\n<\/p>\n<p>3.\tBackground facts as projected by the appellant are as<br \/>\nfollows:\n<\/p>\n<p>4.\tAppellant was born on 28.8.1973 at Mumbai.  His school<br \/>\nleaving certificate shows that the appellant was admitted to<br \/>\nKarnataka High School at Chembur, Mumbai and left the<br \/>\nschool on 29.8.1988.  On 4.12.1993 the Reserve Bank of India<br \/>\n(for short &#8216;RBI&#8217;) granted permission to the appellant under<br \/>\nSection 29(1)(b) of the Foreign Exchange Regulation Act, 1973<br \/>\n(for short &#8216;FERA&#8217;) for acquisition of shares in business in India.<br \/>\nHe also entered into catering contract at a railway station in<br \/>\nMaharashtra. On 15.7.2003 the appellant applied for<br \/>\ncitizenship under Section 6 of the Citizenship Act, 1955 (for<br \/>\nshort &#8216;Act&#8217;).  Initially the State Government wrote a letter to the<br \/>\nCentral Government regarding grant of citizenship by<br \/>\nnaturalistion under Section 6(1) of the Act.  A letter was also<br \/>\nwritten by the Under Secretary, Government of India,<br \/>\nstipulating certain conditions for accepting the prayer of the<br \/>\nappellant.  Thereafter, the appellant got in touch with the<br \/>\nConsulate General of Iran on several occasions.  An order of<br \/>\ndeportation was passed against the appellant on 7.10.2005.  A<br \/>\nwrit petition was filed before the Bombay High Court<br \/>\nchallenging the order.  The same was dismissed on 17.2.2006.<br \/>\nHowever, this Court allowed the Writ Petition (criminal) no.17 of<br \/>\n2006 with certain directions.  Appellant&#8217;s case is that though<br \/>\nhis presence was required by the police officials, notices were<br \/>\nissued without specifying any reason. Notice was issued by<br \/>\nDeputy Commissioner of Police, Mumbai requiring appellant&#8217;s<br \/>\npresence on 3.4.2006.  A detailed reply was filed on 4.4.2006.<br \/>\nWarning was issued on 7.4.2006 to remain present on<br \/>\n10.4.2006.  Reply was submitted on that date.  On 26.5.2006<br \/>\nnotice was issued by the Inspector of Police to the appellant<br \/>\nrequiring his presence in the office. On 26.5.2006 notice dated<br \/>\n10.4.2006 was received by the appellant directing him to leave<br \/>\nthe country. Reply was submitted by the appellant on<br \/>\n10.6.2006. A Writ Petition was filed (W.P. 1262\/06) with<br \/>\nprayers for (a) grant of Indian citizenship by naturalization; (b)<br \/>\nnot to interfere with the appellant&#8217;s right of residence in India;\n<\/p>\n<p>(c) not to deport the appellant without following the orders of<br \/>\nthis Court.\n<\/p>\n<p>5.\tBy letter dated 29.8.2006, the Under Secretary,<br \/>\nGovernment of India, withdrew the letter dated 15.12.2003<br \/>\ngiving reference to the State Government&#8217;s letter dated<br \/>\n6.7.2006.  On 13.10.2006 the High Court dismissed the writ<br \/>\npetition by the impugned order. On 17.10.2006 notice was<br \/>\nissued to the appellant to leave the country.  The SLP was<br \/>\nthereafter filed and the notice was issued on 6.12.2006 granting<br \/>\nstay of deportation.\n<\/p>\n<p>6.\tAccording to the appellant there is no order passed on his<br \/>\napplication for citizenship.  No reason has been indicated in the<br \/>\ncommunication dated 29.8.2006 as to what was the basis for<br \/>\nholding that citizenship was not to be granted to him in public<br \/>\ninterest. Detailed counter-affidavits have been filed by the<br \/>\nUnion of India and the State of Maharashtra.\n<\/p>\n<p>7.\tHowever, there is no need to refer to them in detail.\n<\/p>\n<p>8.\tLearned Additional Solicitor General and the learned<br \/>\ncounsel appearing for the State of Maharashtra stated that the<br \/>\ncommunication dated 29.8.2006 copy of which was given to the<br \/>\nappellant is the order disposing of the appellant&#8217;s prayer for<br \/>\ngrant of Indian citizenship by naturalization under Section 6(1)<br \/>\nof the Act.  Learned counsel for the appellant stated that even in<br \/>\nthe counter affidavits filed there was no specific stand taken<br \/>\nthat the communication in question was the order in terms of<br \/>\nSection 6(1) of the Act.  In any event, according to him no<br \/>\nreasons have been indicated.\n<\/p>\n<p>9.\tBy way of reply the learned ASG pointed out that Section<br \/>\n14 of the Act makes the position clear that no reasons are<br \/>\nrequired to be assigned for grant or refusal the application<br \/>\nunder Section 5 or 6 of the Act.\n<\/p>\n<p>10.\tIt is not necessary to go into the various points urged in<br \/>\nview of the fact that it is accepted by the learned ASG for the<br \/>\nUnion of India and the learned counsel for the State of<br \/>\nMaharashtra that the communication dated 29.8.2006 is the<br \/>\norder disposing of appellant&#8217;s application for grant of<br \/>\ncitizenship.\n<\/p>\n<p>11.\tIt is open to the appellant to avail such remedy as is<br \/>\navailable in law in view of the said order.
