P.C. against the Judgment and order of acquittal<br \/>\n\tdated 31.12.1998 passed by learned Judicial Magistrate, First Class,<br \/>\n\tMandvi, in Criminal Case No. 337 of 1987, whereby the respondents<br \/>\n\taccused have been acquitted from the charges levelled against them.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the prosecution case are that when complainant<br \/>\n\tNagarbhai Diveliyabhai Vasava, Social Worker, was present in his<br \/>\n\toffice at that time he received information that in Mandvi<br \/>\n\tShivshakti Sow Mill, the Teak Wood are unloaded from the Truck<br \/>\n\tbearing No.GTK 917 and Shri M.V.Patel, Forest Officer of Mandvi<br \/>\n\tSouth Forest Range and Shri Vinubhai Manabhai Chaudhari, Forester<br \/>\n\tare illegally illegally cutting the  Teak Wood  without pass or<br \/>\n\tpermit. On receiving such information Nagarbhai gave information on<br \/>\n\ttelephone to Mandvi Police Station. Therefore, on receipt of said<br \/>\n\tinformation, PSI C.N. Parghi, along with staff and the complainant,<br \/>\n\twent to Shivshakti Sow Mill at 5.30 P.M., where they found that work<br \/>\n\tof cutting of Teak wood was going on in presence of accused Nos.1 &amp;<br \/>\n\t2, without any pass or permit. They seized the goods from the<br \/>\n\taccused after drawing the panchnama. Therefore, complaint for the<br \/>\n\toffences under Sections 379, 114 of I.P. Code read with Section<br \/>\n\t26(F) of Indian Forest Act has been filed against the accused<br \/>\n\trespondents.\n<\/p>\n<p>Thereafter,<br \/>\n\tthe trial was proceeded against the respondent   accused in the<br \/>\n\tCourt of learned Magistrate. To prove the case against the<br \/>\n\trespondents   accused, the prosecution has examined the witnesses<br \/>\n\tand also produced documentary evidence. And at the end of trial,<br \/>\n\tafter recording the statement of accused under Section 313 Cr.P.C.<br \/>\n\tand after hearing the parties, the learned Magistrate has acquitted<br \/>\n\tthe respondents   accused from the charges levelled against them,<br \/>\n\tvide judgment under challenge.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said Judgment and order<br \/>\n\tpassed by the learned Magistrate, the appellant   State has filed<br \/>\n\tpresent Appeal.\n<\/p>\n<p>Learned<br \/>\n\tAPP, appearing on behalf of the appellant, has contended that the<br \/>\n\tJudgment and order of trial Court is against the provisions of law.<br \/>\n\tThe trial Court has not properly appreciated the facts and evidence<br \/>\n\tled by the prosecution and looking to the provisions of law itself<br \/>\n\tit is clearly established that the prosecution has proved the whole<br \/>\n\tingredients of offence against the respondents. The learned APP has<br \/>\n\tcontended that, being the Forest Officer, it was the duty of accused<br \/>\n\tNo.1 to look after the forest produce and instead of that he was<br \/>\n\tdoing illegal activity and in his presence the work of illegally<br \/>\n\tcutting the teak wood was going on.  Learned APP has also taken this<br \/>\n\tCourt through the oral as well as documentary evidence.\n<\/p>\n<p>I<br \/>\n\thave perused the oral as well as documentary evidence. I have also<br \/>\n\tconsidered the submissions made by the learned Public Prosecutor as<br \/>\n\twell as the learned Advocate, appearing for the respondent<br \/>\n\taccused. Looking to the oral as well as documentary evidence it is<br \/>\n\tclearly established that the ingredients of Section 379 of I.P. Code<br \/>\n\tis not proved by the prosecution. Even learned APP is not in a<br \/>\n\tposition to say that how the learned Magistrate has committed an<br \/>\n\terror in not believing the case of the prosecution.\n<\/p>\n<p>I<br \/>\n\thave also gone through the Judgment and order passed by the trial<br \/>\n\tCourt and have also perused the oral as well as documentary evidence<br \/>\n\tproduced before me and also considered the submissions made by the<br \/>\n\tlearned Advocates. The trial Court has found that there is not a<br \/>\n\tsingle iota of evidence to show that accused have committed the<br \/>\n\talleged offence and the prosecution witnesses have also not deposed<br \/>\n\tanything against the accused. The trial Court has also found that<br \/>\n\tfrom the perusal of oral as well as documentary evidence the<br \/>\n\tprosecution has failed to prove the ingredients of Section 379 of<br \/>\n\tI.P. Code as also Section 26 of the Indian Forest Act.  On going<br \/>\n\tthrough the Judgment and order passed by the trial Court and the<br \/>\n\tpapers placed before me, I am of the opinion that the trial Court<br \/>\n\thas not committed any error in not believing the case of the<br \/>\n\tprosecution. I find that the findings recorded by the trial Court<br \/>\n\tare absolutely just and proper and in recording the said findings no<br \/>\n\tillegality or infirmity has been committed by it. The learned Judge<br \/>\n\thas rightly come to the conclusion that the prosecution has<br \/>\n\tmiserably failed to prove the case against the respondents<br \/>\n\taccused.\n<\/p>\n<p>Thus,<br \/>\n\tin my opinion, looking to the evidence on record, from the evidence<br \/>\n\titself it is it clearly established that the prosecution has not<br \/>\n\tproved its case beyond reasonable doubt.\n<\/p>\n<p>At<br \/>\n\tthe out-set it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the trial Court have been<br \/>\n\tvery succinctly explained by the Hon&#8217;ble Apex Court in catena of<br \/>\n\tdecisions. Thus, the powers which this Court may exercise against an<br \/>\n\torder of acquittal are well settled. Thus, in case the appellate<br \/>\n\tCourt agrees with the reasons and the findings given by the lower<br \/>\n\tCourt, then the discussion of evidence is not necessary.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tCourt below and hence find no reason to interfere with the same.<br \/>\n\tHence, the Appeal is hereby dismissed.\n<\/p>\n<p>In<br \/>\n\tview of above the Appeal is dismissed. The Judgment and order dated<br \/>\n\t31.12.1998 passed by the learned Magistrate in Criminal Case No. 337<br \/>\n\tof 1987 is hereby confirmed.
