DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-94 of 2010 with Muli Police Station, District: Surendranagar,<br \/>\n for the offences punishable under Sections 363, 366, 376, 506(2) and<br \/>\n114 of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel appearing for the applicants submit that charge-sheet is<br \/>\nfiled and role attributed to the applicants is of an accomplice and<br \/>\nconsidering the version of the prosecutrix along with other attending<br \/>\ncircumstances, the applicants may be enlarged on bail.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and considering all the above facts,    I am inclined to enlarge<br \/>\nthe applicants on bail.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-94 of 2010 with<br \/>\nMuli Police Station, District: Surendranagar, on executing bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) each with one surety of the<br \/>\nlike amount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that they shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
