P.C., against the Judgment and order dated 29.9.2010,<br \/>\n\trendered in Criminal Case No.1071 of 2007 by the learned<br \/>\n\tMetropolitan Magistrate,  Court No.8, Ahmedabad. The said case was<br \/>\n\tregistered against the present respondent for the offence under<br \/>\n\tSection 7(1) of the Prevention of Food Adulteration Act (for short<br \/>\n\t&#8220;PFA Act&#8221;) in the Court of learned Magistrate,<br \/>\n\tAhmedabad. The said Judgment of the trial Court has been challenged<br \/>\n\tby the complainant on the ground that the Judgment and order passed<br \/>\n\tby learned Magistrate is against the law and evidence on record.\n<\/p>\n<p>According<br \/>\n\tto the prosecution case on 12.10.2006 the complainant along with his<br \/>\n\tpeon visited the premises of the respondent No.2 &#8211; accused and<br \/>\n\ttook the sample of  Mouth-Freshener (Mukhvas) for the purpose of<br \/>\n\tanalysis in the presence of panch. Thereafter, after completing the<br \/>\n\tnecessary procedure, the complainant sent the said samples to the<br \/>\n\tPublic Analyst for analysis. The Public Analyst submitted the report<br \/>\n\tin which it has been found that &#8220;the said sample of<br \/>\n\tMouth-Freshener (Mukhvas) is adulterated.&#8221; Upon receipt of the<br \/>\n\treport the complainant, after obtaining sanction, filed complaint<br \/>\n\tagainst the respondent &#8211; accused in the Court of learned<br \/>\n\tMagistrate, Ahmedabad being Criminal Case No.1071 of 2007.\n<\/p>\n<p>At<br \/>\n\tthe conclusion of trial and after appreciating the oral as well as<br \/>\n\tdocumentary evidence, the learned Magistrate vide impugned Judgment,<br \/>\n\tacquitted the respondent &#8211; accused.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Kapadia, appearing on behalf of the appellant has<br \/>\n\tcontended that the Judgment and order of acquittal is contrary to<br \/>\n\tlaw and evidence on record and is not proper. She has also contended<br \/>\n\tthat the learned trial Judge has failed to appreciate that the<br \/>\n\tsample is found adulterated and the provisions laid down under the<br \/>\n\tAct. She has contended that the trial Court has failed to appreciate<br \/>\n\tthe report of Public Analyst. She has also contended that the<br \/>\n\toffence punishable under the Act are directly connected with the<br \/>\n\thealth of public at large.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced in the Case. I have also gone<br \/>\n\tthrough the evidence led before the trial Court as well as the<br \/>\n\tExpert Opinion. I have also gone through the Judgment of the trial<br \/>\n\tCourt. From the judgment, it appears that form the report of the<br \/>\n\tPublic Analyst, it appears that in the sample of Mouth Freshener,<br \/>\n\tthe presence about synthetic colour, which is permitted colour or<br \/>\n\tnon-permitted, is not mentioned by the Public Analyst and even which<br \/>\n\tRule is violated is also not stated in the report. The aluminum foil<br \/>\n\tis not harmful to human life and there is no standard fixed in the<br \/>\n\tAppendix B.  Therefore, the Food Inspector has violated the<br \/>\n\tprocedure laid down under Rules. In the facts of the case I am in<br \/>\n\tcomplete agreement with the reasons assigned by the trial Court.\n<\/p>\n<p>It<br \/>\n\tis settled legal position that in acquittal Appeal, the Appellate<br \/>\n\tCourt is not required to re-write the Judgment or to give fresh<br \/>\n\treasonings when the Appellate Court is in agreement with the reasons<br \/>\n\tassigned by the trial Court acquitting the accused. In the instant<br \/>\n\tcase, this Court is in full agreement with the reasons given and<br \/>\n\tfindings recorded by the trial Court while acquitting the<br \/>\n\trespondents &#8211; accused and adopting the said reasons and for<br \/>\n\tthe reasons aforesaid, in my view, the impugned Judgment is just,<br \/>\n\tlegal and proper and requires no interference by this Court at this<br \/>\n\tstage. Hence, this Appeal requires to be dismissed.\n<\/p>\n<p>In<br \/>\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment<br \/>\n\tand order dated 29.9.2010 passed by the learned Metropolitan<br \/>\n\tMagistrate, Court No.8, Ahmedabad in Criminal Case No. 1071 of 2007,<br \/>\n\tacquitting the respondent &#8211; accused, is hereby confirmed.
