Justice V.GIRI\n\n Dated :31\/01\/2008\n\n O R D E R\n                              V.GIRI, J\n\n                            -------------------\n\n                        W.P.(C).2946\/2008\n\n                            --------------------\n\n          Dated this  the  31st  day of January, 2008\n\n\n                            JUDGMENT\n<\/pre>\n<p>      In  the  course of providing guarantee for   the  fourth<\/p>\n<p>respondent, who had prized two chitties  for Rs.6,00,000\/-,<\/p>\n<p>petitioner   had   mortgaged   51   cents   of   property   in<\/p>\n<p>Puduppadi village as a security  for re-payment of the loan.<\/p>\n<p>Apparently, there has been considerable default in the re-<\/p>\n<p>payment of the loan.   It further seems that the petitioner,<\/p>\n<p>who   was   independently   a   subscriber   to   the   chitty   for   an<\/p>\n<p>amount of Rs.6,00,000\/-, had kept the   amount   in deposit<\/p>\n<p>with the Financial Enterprises.   Recovery steps have now<\/p>\n<p>been initiated as against the mortgaged property which is<\/p>\n<p>proposed  to be  brought  to sale  on  7.2.2008   as evidenced<\/p>\n<p>by Exts.P1 and P2.   In the circumstances,   petitioner  has<\/p>\n<p>approached this Court.\n<\/p>\n<\/p>\n<p>2.    Learned   Standing   Counsel,   on   instructions,   submits<\/p>\n<p>that   an   amount   of   Rs.11,34,000\/-   (approximate)   is   due<\/p>\n<p>from   the   fourth   respondent,     as   on   date   and   therefore,<\/p>\n<p>sale   of   the   mortgaged   property   seems   inevitable.         He<\/p>\n<p>W.P.(C).2946\/2007<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>further   submits that  if there    is a  proper   application  by<\/p>\n<p>the   principal   debtor   along   with   the   surety            for<\/p>\n<p>consideration   of   their   case   under   the   One   Time<\/p>\n<p>Settlement scheme, the   respondent is ready and willing<\/p>\n<p>to consider the same.  Submission is recorded.<\/p>\n<p>3.    In the result,  writ petition is disposed of permitting<\/p>\n<p>the   petitioner,   along   with   the   fourth   respondent,   to<\/p>\n<p>approach   the   first   respondent,   KSFE,   under   the   One<\/p>\n<p>Time Settlement scheme.  If an application on this behalf<\/p>\n<p>is filed in accordance with the guidelines under the  One<\/p>\n<p>Time   Settlement   scheme   on   or   before   28.2.2008,   same<\/p>\n<p>shall   be   considered   and   appropriate   decision   taken<\/p>\n<p>thereon and communicated it to the parties on or before<\/p>\n<p>31.3.2008.     Applicants   under   the   One   Time   Settlement<\/p>\n<p>scheme     shall   be   bound   by   the   directions   to   pay   the<\/p>\n<p>amount determined thereunder.\n<\/p>\n<\/p>\n<p>4.
