I have heard the learned Counsel for the <\/p>\n

2. The relevant facts leading to this reiiision petition<\/p>\n
is as under:\n<\/p>\n

Employees Provident Fund’  for taking<\/p>\n

\nEmployees’  Miscellaneous Provisions
\nAct, 1952:.’ ” One   the Inspector appointed under<\/p>\n

\n servant””‘w1t.y11n.’:’.-V name meaning of Section 21 of IPC and<\/p>\n
 as ‘Assistant Pu’biic Prosecutor for the purpose of<\/p>\n

eor;.d:u.e’f;iiig the cases arising out of the Employees’ Provident
\n V   Schemes framed there under. The Farmers’s Coop<\/p>\n
 Mill Ltd., Hulko\ufb01 is a establishment within the<\/p>\n
meaning of the Employees Provident Funds and
\nMiscellarieous Provisions Act, 1952. The Employees’<\/p>\n
Provident Fund and Miscellaneous Frovisions Act 1952, the
\n‘Km’<\/p>\n
4*<\/p>\n
I During the relevant pexiod, the accused was incharge of the<\/p>\n
said factory and was responsible for the conduct of the<\/p>\n
business. But, due to their negligence, they have committed<\/p>\n
an offence punishable under Section 14 and 14(1A)<\/p>\n
Employees’ Provident Funds and Miseeilaneous  ‘ <\/p>\n
Act, 1952. The reasonable opportunity \\f.:as~\u00a7ven ton  <\/p>\n
accused for payment of dues, but the acetised-jt\u00e9ide tfneir-]ette’s’*~.r <\/p>\n
dated 30.08.2003 pleaded time
\nThe sanction order dated  .22. 1 for  ‘above
\nprosecution has been wanted    Fund<\/p>\n
Commissioner, Hubii,   eontiplaint was<\/p>\n
case against thewaccufsed”1:and4″‘As_sued process. Hence, the<\/p>\n
case was registered. ~<\/p>\n
3, Aggreived   , same, the petitioners have<\/p>\n
preferrediithisijp  “before this Court.<\/p>\n
  for the petitioners submit that<\/p>\n
the.i.i\u00a7}i;rector caiinot be made as a party for these proceedings,<\/p>\n
   .._en’*e not dealing with the business. The<\/p>\n
‘*~:._’.__cont1t.i’i3nn_’Mon amount has not been recovered from the<\/p>\n
 Therefore, the question of depositing the amount<\/p>\n
before the Insurance Organisation does not arise. He further<\/p>\n
contended that the ad:ministrative charges have been paid for

5. It is the contention of the learned Counsel forthe<\/p>\n
petitioner that the accused are Chairman, Vice <\/p>\n

7. In View of this Section, the submission of the<\/p>\n
learned Counsel for the petitioner that the Chairman, Vice<\/p>\n

Chairman aud Director were not responsible for conduct of<\/p>\n
the business of the company cannot be accepted.<\/p>\n

complainant discloses that in spite of several 2  M<\/p>\n
._ accused have not deposited the EFF icohtrichu-.tiop” <\/p>\n
to the mouth of January, February,   <\/p>\n
of quashing a criminal proceedihgirjlciishould be  livery it<\/p>\n
sparingly and with   too  rarest
\nof rare cases. Further,   be justi\ufb01ed in
\nembarking upon    tjo..  reliability or
\ngenuineness or   made in the FIR
\nor the complaiht;   caserreasonable opporutnicty
\nwas also given to  taayment of the said dues,
\nbut the accused dated 30.08.2003, pleaded for
\ntigrim, __ sspite  this,””Cont1ibution amount was not paid.<\/p>\n

V it . 9. is hot the case that; the complamt \ufb01led by the<\/p>\n
 frivilous, vexatious and oppressive. Normally,<\/p>\n
  exercise the power to quash proceedings only in<\/p>\n
  V  casewhere the complaint is vexatious or irivilous and it does<\/p>\n
 make out any offence alleged against him. Taking into<\/p>\n
account of all the aspects of the case and also material placed<\/p>\n
on record, in my view, this Criminal Petition is devoid of<\/p>\n
