SIRI JAGAN, J.\n                 -----------------------------------\n                    W.P.(C) No.36463 OF 2010\n               ---------------------------------------\n            Dated this the 10th day of January, 2011\n\n                              JUDGMENT\n<\/pre>\n<p>      The petitioner has been included in the rank list prepared by<\/p>\n<p>the Kerala Public Service Commission in the selection process for<\/p>\n<p>appointment     to    the    post     of   Junior    Assistants\/Cashiers\/<\/p>\n<p>L.D.Clerks\/ Junior Clerk in various departments. According to the<\/p>\n<p>petitioner, although there are vacancies available in the Pollution<\/p>\n<p>Control Board, the vacancies have not been reported to the PSC<\/p>\n<p>for advice of candidates from the rank list prepared.                  On<\/p>\n<p>15.12.2010, I passed the following order in this writ petition:<\/p>\n<blockquote><p>          &#8220;When it was pointed out to the counsel for the petitioner<br \/>\n          that the petitioner has been included in the rank list for<br \/>\n          the post of Junior Assistants\/Cashiers\/L.D.Clerks in various<br \/>\n          departments of Government and the Pollution Control<br \/>\n          Board is not a department of the Government, the<br \/>\n          vacancies in which can be filled up from the rank list,<br \/>\n          counsel for the petitioner seeks time.&#8221;\n<\/p><\/blockquote>\n<p>Today, the learned counsel for the petitioner admits that the<\/p>\n<p>Pollution Control Board is not a department of the Government.<\/p>\n<p>But, the contention raised is that since the Pollution Control<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.36463\/10                2<\/span><\/p>\n<p>Board is a statutory authority under the Government, advice<\/p>\n<p>can be made from that list.\n<\/p>\n<p>      I am not inclined to countenance the contention of the<\/p>\n<p>petitioner.     When a rank list has been prepared for<\/p>\n<p>appointment to the post in various departments of the<\/p>\n<p>Government, that rank list cannot be operated for appointment<\/p>\n<p>in establishments which are not Government departments,<\/p>\n<p>even    if  those   establishments    are   controlled    by   the<\/p>\n<p>Government.      Therefore, there is no merit in this writ petition<\/p>\n<p>and accordingly, the same is dismissed.\n<\/p>\n<\/p>\n<p>                                     S.
