Respondents.\n\t\t\t\t\t\t\t     \t\nPRAYER\n\nPetition filed under Article 226 of the Constitution of India, praying\nfor a Writ of Certiorari, to call for the records of the third respondent in\nLr.No.SE\/VDR\/AO\/R\/RCS\/AS\/F.HT SC.300\/D.  \/2009 dated 30.11.2009, and quash the\nsame in so far as it relates to the levy of penalty for allegedly exceeding\nquota during evening peak hours as illegal, arbitrary, without the authority of\nlaw and against the orders of the 1st respondent made in Miscellaneous Petition\nNo.42 of 2008, dated 28.11.2008.\n\n!For Petitioner ... No Appearance (R1)\n\t\t    Mr.M.Suresh Kumar (TNEB) (R2 &amp; R3)\n\n:ORDER\n<\/pre>\n<p>\tHeard the learned counsels appearing on behalf of the parties concerned.\n<\/p>\n<p>\t2. Even though various averments have been made and many grounds had been<br \/>\nraised in the affidavit filed in support of the writ petitions, the main<br \/>\ngrievance of the petitioners are that the impugned demand notice\/bill in respect<br \/>\nof the peak hour penalty has been issued by the third respondent, without due<br \/>\nnotice being given to the petitioners and without affording sufficient<br \/>\nopportunity of hearing to the petitioners.\n<\/p>\n<p>\t3. The learned counsel appearing on behalf of the petitioners has stated<br \/>\nthat the third respondent has no authority, under the relevant provisions of the<br \/>\nlaw, to levy the penalty, without the prior approval of the Tamil Nadu<br \/>\nElectricity Regulatory Commission, which is the competent statutory authority,<br \/>\nestablished in accordance with the Electricity Act, 2003.\n<\/p>\n<p>\t4. It has been further stated that the third respondent had failed to<br \/>\nfollow the procedures laid down, under paragraph No.33 of the order, made in<br \/>\nM.P.No.42 of 2008, dated 28.11.2008, issued by the Tamil Nadu Electricity<br \/>\nRegulatory Commission. Therefore, the impugned demand notice\/bill issued by the<br \/>\nthird respondent is liable to be set aside.\n<\/p>\n<p>\t5. Mr.M.Suresh Kumar the learned counsel, appearing on behalf of the 2nd<br \/>\nand 3rd respondents, had not refuted the claims made by the learned counsel<br \/>\nappearing on behalf of the petitioners. However, he had submitted that if this<br \/>\nCourt deems it fit to set aside the impugned demand notice\/bill of the third<br \/>\nrespondent, liberty may be granted to the third respondent to pass appropriate<br \/>\norders, afresh, after due notice is issued to the petitioners.\n<\/p>\n<p>\t6. In view of the submissions made by the learned counsels appearing for<br \/>\nthe petitioners, as well as the respondents, and in view of the orders passed by<br \/>\nthis Court, in a number of writ petitions, wherein similar issues have been<br \/>\nraised, the impugned demand notice\/bill, issued by the third respondent, is set<br \/>\naside. However, it would be open to the third respondent to pass appropriate<br \/>\norders, afresh, including the issuing of the appropriate demand notice\/bill,<br \/>\nafter giving due notice and after affording sufficient opportunity of hearing to<br \/>\nthe petitioners.\n<\/p>\n<p>\t7. After due notice is issued by the third respondent, the petitioners<br \/>\nwould be at liberty to challenge the same, if it is found necessary to do so, by<br \/>\nraising all the grounds available to the petitioners, including those which have<br \/>\nbeen raised in these writ petitions. It would also be open to the petitioners to<br \/>\nraise the ground that the third respondent has no authority to levy the penalty,<br \/>\non the ground that it is against the dictum laid down by the Tamil Nadu<br \/>\nRegulatory Commission, in M.P.No.42 of 2008, dated 28.11.2008.\n<\/p>\n<p>\t8. In case the petitioners had already paid the bill amount it would be<br \/>\nadjusted to the amounts that may be claimed by the Tamilnadu Electricity Board,<br \/>\nin the future bills relating to the petitioners, in case the final decision is<br \/>\nin favour of the petitioners. The petitioners shall fully cooperate by<br \/>\nparticipating in the inquiry or hearing that may be held by the concerned<br \/>\nauthorities of the respondent Electricity Board.<br \/>\n\t\tThese writ petitions are ordered accordingly.
