Khagaria\n                 District Khagariya                            ........Petitioner\n                                            Versus\n                 The State of Bihar                  .................Opposite Party.\n                                            -----------\n<\/pre>\n<p>2   22.07.2011                 Heard.\n<\/p>\n<p>                               In a criminal prosecution registered under sections<\/p>\n<p>                 302, 394\/34 of the Indian Penal Code as also under section 27 of<\/p>\n<p>                 the Arms Act, petitioner is not named in the first information<\/p>\n<p>                 report as an accused.\n<\/p>\n<p>                               It is    submitted that petitioner&#8217;s complicity in the<\/p>\n<p>                 crime in question is attributed merely on the basis of<\/p>\n<p>                 confessional statement of co-accused persons recorded by the<\/p>\n<p>                 police. It is also submitted that even in the alleged confessional<\/p>\n<p>                 statement recorded by the police specific allegation for<\/p>\n<p>                 committing the crime of murder has not been attributed against<\/p>\n<p>                 the petitioner. Learned counsel for the petitioner further submits<\/p>\n<p>                 that petitioner was forwarded by the police in the present case on<\/p>\n<p>                 13.12.2006.\n<\/p>\n<p>                               Be that as it may, in the facts and circumstances of<\/p>\n<p>                 the case, the above named petitioner is directed to be released on<\/p>\n<p>                 bail on furnishing bail bond of Rs. 10,000\/- (ten thousand) with<\/p>\n<p>                 two sureties of like amount each to the satisfaction of<\/p>\n<p>                 Additional District Judge-IV , Patna in connection with S.T. No.<\/p>\n<p>                 787\/08 arising out of S.K. Puri P.S. Case No.178\/06 subject to<\/p>\n<p>                 the conditions:\n<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                        (a) That one of the bailors must be Govt. servant or<\/p>\n<p>          close family member of the petitioner who will file an affidavit<\/p>\n<p>          in the court below showing his\/her relationship with the<\/p>\n<p>          petitioner.\n<\/p>\n<p>                        (b) If the petitioner is found involved in same and<\/p>\n<p>          similar nature of cases in future, then in that case the<\/p>\n<p>          informant\/prosecution shall be at liberty to file a petition for<\/p>\n<p>          cancellation of the bail of the petitioner, and if such a petition is<\/p>\n<p>          filed, the court below would be obliged to dispose of the same in<\/p>\n<p>          accordance with law after giving opportunity of hearing to all<\/p>\n<p>          concerned.\n<\/p>\n<p>                        (c) The petitioner shall make regular pairvi in the<\/p>\n<p>          court below in the present case either by appearing himself in<\/p>\n<p>          person or through representation by his lawyer on each and<\/p>\n<p>          every dates, and if on two consecutive dates petitioner fails to<\/p>\n<p>          make pairvi, then the court below shall be at liberty to cancel<\/p>\n<p>          the bail bond of the petitioner.\n<\/p>\n<\/p>\n<p>                                     ( Birendra Prasad Verma, J.)<br \/>\nRahman\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Raja Sahni @ Gunjba @ Gunja vs The State Of Bihar on 22 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
