During the<br \/>\ncourse of his service in the army, he mishandled<br \/>\nhis loaded weapon of which he was<br \/>\nfound to be negligent, as a result of which, he<br \/>\nsuffered 14 days rigorous imprisonment.<br \/>\nAccidental shot fractured his right foot, as a<br \/>\nconsequence of which, he was down-graded to<br \/>\nlow medical category CEE (T) from 16th<br \/>\nDecember, 1997. The petitioner-respondent was<br \/>\nbrought before the Release Medical Board on<br \/>\n21st October, 2000. The Board after examining<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nthe petitioner-respondent found that he was<br \/>\nsuffering from the following disabilities:-\n<\/p>\n<p>(i) GSW(Rt.) foot communicated-1 to<br \/>\n5% (Composite Fracture 2nd<br \/>\nMetatarsal (For life): Assessment<br \/>\nE 922 V 67;\n<\/p>\n<p>(ii) Essential Hypertension 401 V467<br \/>\n: 30% (All disabilities for two years<br \/>\n30%.\n<\/p>\n<p>After his discharge, the claim of the<br \/>\npetitioner-respondent for grant of disability<br \/>\npension was forwarded to the Chief Controller<br \/>\nof Defence Accounts (Pension) Allahabad, who<br \/>\nrejected the same vide his communication dated<br \/>\n26.07.2001. This order was subject matter of<br \/>\nchallenge in SWP No.2952\/2001. The writ court<br \/>\nafter hearing the parties found that the<br \/>\npetitioner-respondent suffered from essential<br \/>\nhypertension, which was assessed at 30%. He<br \/>\nwas discharged in the exercise of power<br \/>\nconferred under Army Rule 13(3) Item III (v).<br \/>\nThe writ Court found that the hypertension was a<br \/>\ndisease, which could occur on account of<br \/>\nhazards of military service. Reliance has been<br \/>\nplaced on various judgments of this Court<br \/>\nindicating that it is the environment to which a<br \/>\nperson is subjected to, the diseases like mental<br \/>\nstress, depression and high blood pressure<br \/>\noccur.\n<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>The stand of the appellant was that the<br \/>\ndisease was constitutional in nature and not<br \/>\nattributable to military service. This submission<br \/>\ndid not find favour with the writ Court, which<br \/>\ndirected that the disability pension be released<br \/>\nin favour of the petitioner-respondent as the<br \/>\nmalady of essential hypertension has occurred<br \/>\non account of hazards of military service and<br \/>\nwould be attributable or aggravated to by the<br \/>\narmy service. It is this order of the writ Court<br \/>\nwhich is subject matter challenge before us<br \/>\nthrough the medium of the present appeal.<br \/>\nThe controversy in this appeal is within a<br \/>\nvery narrow compass. It is not disputed that the<br \/>\npetitioner-respondent was suffering from<br \/>\nessential hypertension and his disability was<br \/>\nassessed 30% by the Release Medical Board.<br \/>\nHe would become entitle for grant of disability<br \/>\npension in terms of Regulation 173 of the Army<br \/>\nPension Regulations if the disability is above<br \/>\n20%. The only impediment in grant of disability<br \/>\npension would be that the disease of which a<br \/>\nperson is afflicted is not attributable to military<br \/>\nservice. This could only be detected at the time<br \/>\na person is initially recruited in the army. In case<br \/>\nsaid disease could not be detected at that stage,<br \/>\nthe Release Medical Board was required to<br \/>\nappend a certificate indicating that this disease<br \/>\ncould not have been detected at the stage of<br \/>\nrecruitment. No such certificate has been<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nappended or produced before the court to<br \/>\nindicate that the said disease could not have<br \/>\nbeen detected at the time when the petitionerrespondent<br \/>\nwas enrolled in the Indian army.\n<\/p>\n<p>Having failed to do so, the appellant<br \/>\ncannot escape from its liability to pay disability<br \/>\npension to the petitioner-respondent. The order<br \/>\npassed by the Chief Controller of Defence<br \/>\nAccounts (Pension), Allahabad rejecting the<br \/>\nclaim of the petitioner-respondent, in the face of<br \/>\nthe report submitted by the Release Medical<br \/>\nBoard, was uncalled for. Learned Single Judge<br \/>\nhas rightly stated that he could not be in a<br \/>\nposition to state that the petitioner was not<br \/>\nentitled to disability pension once an expert has<br \/>\nfound that he was suffering from disability which<br \/>\nwas assessed more than 30%.\n<\/p>\n<p>What has been stated hereinabove, we find<br \/>\nno force in this appeal.
