Justice V.RAMKUMAR\n\n Dated :07\/06\/2010\n\n O R D E R\n                             V.RAMKUMAR, J\n                ......................................................\n                         W.P.C. 17553 of 2010\n             ...........................................................\n\n                    Dated, 7th day of June, 2010\n\n                                 JUDGMENT\n<\/pre>\n<p>      The petitioner who claims to be a physically handicapped<\/p>\n<p>woman aged 46 years residing along with her minor son in<\/p>\n<p>Ward No. 7 at Ambalappuzha Grama Panchayath inter alia seeks<\/p>\n<p>a direction against the 2nd respondent Superintendent of Police<\/p>\n<p>Alappuzha, to relieve                   the Sub Inspector of Police,<\/p>\n<p>Ambalappuzha from the investigation of Crime No. 301 of 2010<\/p>\n<p>of Ambalappuzha Police Station and to direct the Superintendent<\/p>\n<p>of Police either to investigate the case himself or to entrust the<\/p>\n<p>investigation with a senior police officer other than the Sub<\/p>\n<p>Inspector of Police, Ambalappuzha after calling for the records in<\/p>\n<p>the above crime. According to the petitioner the 4th respondent,<\/p>\n<p>Venugopal, who is the brother of the petitioner is a practicing<\/p>\n<p>lawyer in the Ambalappzha Courts, and therefore, she may not<\/p>\n<p>get justice , if she approaches the J.F.C.M. Ambalappuzha with a<\/p>\n<p>petition under Sec. 156 (3) Cr.P.C.\n<\/p>\n<p>      2.   After the verdict of the Apex Court in Sakiri Vasu v.<\/p>\n<p><span class=\"hidden_text\">W.P.C. 17553 of 2010             -:2:-<\/span><\/p>\n<p>State of U.P. 2008 (1) KLT 724 (SC) the power lies with the<\/p>\n<p>Magistrate concerned to monitor the investigation of the crime<\/p>\n<p>and the remedy of the petitioner is to move the Magistrate. I do<\/p>\n<p>not think that the Judicial Officers in the State are amenable to<\/p>\n<p>extraneous considerations such as one of the accused persons<\/p>\n<p>being a practicing lawyer before them. The Magistracy in the<\/p>\n<p>State are far above such considerations and I see no reason as to<\/p>\n<p>why the Magistrate      is, if approached, will show any sort of<\/p>\n<p>partisanship or leniency towards the       4th respondent merely<\/p>\n<p>because he is a practicing lawyer in that Court.         The legal<\/p>\n<p>remedies of a litigant cannot be channalised to suit his or her<\/p>\n<p>convenience merely because he or she is apprehensive of the<\/p>\n<p>opposite party in the case. This       Writ Petition is accordingly<\/p>\n<p>dismissed without prejudice to the right of the petitioner to move<\/p>\n<p>the appropriate Magistrate for suitable reliefs in the light of the<\/p>\n<p>verdicts in <a href=\"\/doc\/1836621\/\">Sakiri Vasu v. State of U.P.<\/a> (supra) and <a href=\"\/doc\/328118\/\">Kunga<\/p>\n<p>Nima Lepcha and Others v.
