C.\n\nHon'ble Shishir Kumar,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and learned Standing<br \/>\nCounsel.\n<\/p>\n<p>Petitioner is aggrieved by the order dated 26.07.2010, by which he<br \/>\nhas been transferred from the office of District Inspector of<br \/>\nSchools to the Government Girls Inter College in the same district.<br \/>\nAccording to petitioner, a Government Order was issued on<br \/>\n09.06.2010 taking a decision that persons, who have completed<br \/>\nthree years of service at a particular place, their place may be<br \/>\nchanged. Subsequently, under the direction issued by the<br \/>\nEducation Minister a decision has been taken on 13.07.2010 that<br \/>\nall the persons, who are working as Group-C employee, if they<br \/>\nhave completed five years of service at a particular place, they<br \/>\nshould be transferred in the same district amongst the other offices<br \/>\nof Education Department like Government Inter Colleges.<br \/>\nAccording to petitioner, Education Minister has no concern with<br \/>\nthe transfer and posting of the employees. The circular dated<br \/>\n13.07.2010 is a decision imposed by the Education Minister to the<br \/>\nDirector of Education to transfer all the employees who have<br \/>\ncompleted five years of service. Further submission has been made<br \/>\nthat no other reason has been recorded while passing the order<br \/>\nexcept they are being transferred only on the ground that they have<br \/>\ncompleted five years of tenure at a particular place.\n<\/p>\n<p>I have considered the submissions of learned counsel for the<br \/>\nparties. It appears that in a meeting headed by the Education<br \/>\nMinister a decision was taken that the employees working under<br \/>\nthe Joint Director of Education in every district, who have<br \/>\ncompleted five years of tenure at a particular place, may be<br \/>\ntransferred to another branch of Education Department or<br \/>\nGovernment Inter Colleges. Taking into consideration the<br \/>\naforesaid fact, various persons have been transferred. It is not the<br \/>\ncase of the petitioner that he has not completed five years of<br \/>\ntenure. Further, it is a general order of transfer from one place to<br \/>\nanother in the same district. Transfer being an exigency of service<br \/>\n petitioner cannot claim as a matter of right that he cannot be<br \/>\ntransferred from one place to another in spite of the fact that a<br \/>\ndecision to this effect has been taken that if a person has<br \/>\ncompleted five years of tenure at a particular place, he will be<br \/>\ntransferred to another place in the same district. In case, petitioner<br \/>\nhas been transferred to another district, then he can have any<br \/>\ngrievance before this Court, but he has been transferred in the<br \/>\nsame district and only the place of work has been changed,<br \/>\ntherefore, he cannot raise any objection to this effect.\n<\/p>\n<p>In view of the aforesaid fact, this writ petition has no merit and is<br \/>\nhereby dismissed.
