No.37541 of 2011\n                 Rajiv Kumar Singh, son of Late Maheshwari Prasad Singh, resident of\n                 village-Matihani, P.S.-Matihani in the district of Begusarai.\n                                                                        .........Petitioner\n                                         Versus\n                 The State of Bihar                                     ..........Opp. Party.\n                                        -----------\n<\/pre>\n<p>2   16.11.2011                   Heard learned counsel for the petitioner and learned counsel<\/p>\n<p>                       appearing on behalf of the State.\n<\/p>\n<p>                                 The petitioner is in custody since 4.7.2011 in a case registered<\/p>\n<p>                       for the offence under Section 302\/34 and 120B of the Indian Penal<\/p>\n<p>                       Code.\n<\/p>\n<p>                                 It is submitted that though seven persons have been named in<\/p>\n<p>                       the F.I.R, the petitioner is not named. His name transpired in course of<\/p>\n<p>                       investigation on the basis of confessional statement of a co-accused<\/p>\n<p>                       Rohit Kumar. Apart from confessional statement of Rohit Kumar, the<\/p>\n<p>                       confessional statement of petitioner is also said to be there in the case<\/p>\n<p>                       diary.\n<\/p>\n<p>                                 The learned counsel for the petitioner submits that save and<\/p>\n<p>                       except confessional statement, there is no material in the case diary to<\/p>\n<p>                       connect him with the allegation. The investigation is complete and<\/p>\n<p>                       charge sheet has already been submitted against the petitioner.<\/p>\n<p>                                 Considering the facts and circumstances of the case, the<\/p>\n<p>                       petitioner is directed to be released on bail on furnishing bail bonds of<\/p>\n<p>                       Rs. 10,000\/- (Ten Thousand only) with two sureties of the like amount<\/p>\n<p>                       each to the satisfaction of the learned Chief Judicial Magistrate,<\/p>\n<p>                       Begusarai in connection with Barauni (Chakia) P.S.
