Heard     learned    counsel    for     the<\/p>\n<p>                  parties.\n<\/p>\n<p>                             2. This writ petition has been filed by<\/p>\n<p>                  the petitioner for quashing the order bearing<\/p>\n<p>                  Memo No. 715 Dated 6.9.2010(Annexure-9) by which<\/p>\n<p>                  the   Executive       Director   Bihar   Industrial    Area<\/p>\n<p>                  Development Authority, Regional Office Bhagalpur<\/p>\n<p>                  (respondent No. 2) cancelled the allotment of<\/p>\n<p>                  Plot No. 24 (part) having an area of 2.5 acres<\/p>\n<p>                  within the industrial area Katihar, which was<\/p>\n<p>                  earlier allotted         to M\/s Vijay Food Products,<\/p>\n<p>                  proprietor of which is the present petitioner,<\/p>\n<p>                  was immediate effect and the amount deposited by<\/p>\n<p>                  the petitioner was forfeited. Further prayer is<\/p>\n<p>                  made to direct the respondents authorities to<\/p>\n<p>                  consider        the     representation\/appeal         dated<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>4.10.2010(Annexure-10)                 of    petitioner             pending<\/p>\n<p>before respondent No. 2 to grant\/extend the time<\/p>\n<p>for starting his business on the said plot.<\/p>\n<p>            3. So far the second relief sought by<\/p>\n<p>the petitioner is concerned, this writ petition<\/p>\n<p>is disposed of with a direction to the Executive<\/p>\n<p>Director      Bihar           Industrial          Area     Development<\/p>\n<p>Authority Regional Office, Bhagalpur(respondent<\/p>\n<p>No. 2) to decide the representation\/appeal filed<\/p>\n<p>by the petitioner on 4.10.2010 by a speaking<\/p>\n<p>order,      expeditiously             within       two        months       of<\/p>\n<p>receipt\/production of a copy of this order.<\/p>\n<p>            4. So far the first relief sought by the<\/p>\n<p>petitioner        is       concerned    it    transpires            from    a<\/p>\n<p>perusal of the impugned order dated 06.09.2010<\/p>\n<p>that   it    is    a        communication         by    the    Executive<\/p>\n<p>Director, with respect to the order which had<\/p>\n<p>been   passed          by    the   Managing        Director,          Bihar<\/p>\n<p>Industrial         Area        Development             Bhagalpur        and<\/p>\n<p>against     such       an     order    an    appeal       is    provided<\/p>\n<p>under Section 6(2)(A) of the Bihar Industrial<\/p>\n<p>Areas Act 1974 before the State Government.<\/p>\n<p>            5. In the said circumstance this writ<\/p>\n<p>petition is disposed of with a liberty to the<\/p>\n<p>petitioner to file a statutory appeal before the<\/p>\n<p>said   Appellate            Authority.
